ORDINANCE NO. <br />AN ORDINANCE AMENDING THE GOVERNING <br />RULES AND REGULATIONS OF THE LEGIS- <br />LATIVE BRANCH OF THE CITY OF SOUTH <br />BEND, CHAPTER 2, ARTICLE 1, ENTITLED <br />"THE COMMON COUNCIL ",.OF THE MUNICIPAL CODE <br />STATEMENT OF PURPOSES AND INTENT <br />The Common Council of ,the City of South Bend recognizes that <br />its citizens are. entitled to an efficient and responsible legislative <br />branch of government. <br />In the interest of assuring that all of the local governing <br />laws are consistent with new state legislation, the following bill is <br />introduced to revise the procedure to fill any vacancies occuring in <br />the Common Council; and to require written annual reports of all stand- <br />ing committees of the Council. <br />NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City <br />of South Bend, Indiana, as follows: <br />SECTION I. Chapter 2, Article 1, Section 2 -1(e) of the Munici- <br />pal Code of the City of South Bend, Indiana, is hereby amended to read <br />as follows: <br />(e) In the case of a vacancy in the office of councilman from <br />death, resignation, or other cause, the- Eees- Eessell- shall- }le -sseh <br />b�aeasey- at- a- s�eelal- �teet�s .g- te- be- �.e�d- at- a -t��e- set - less - than- t6ae -��} <br />sew- x�e�e -th. are- �lttees- �l� } -d. ads -a�' tee- sse�i- �aease�- }s- d�seeb�ered- <br />A�te�- p�ege�- settee;- the- Eeesell- shall - X111- s�eh- baaeasey- hy- �ta�e��ty <br />mete -e�- all- eesr�ellx�es- balt�i -a- verses- bah. e- x��st- be- a- resldest -e�- the -dls- <br />t�}et-t�ex�-bahleh-eesse}lx�as- was- eleeted;- e�eegt -ls -the- ease- e�- eessell- <br />men- at- laEge- such vacancy shall be filled pursuant to the procedure <br />set forth in Indiana Code Sections 3 -2 -9 -1 through 3- 2 -9 -10. However, <br />if the vacancy is of a district councilman, the person selected to ll <br />such vacancy must be a resident of the district from which the vacated <br />councilman was elected. All persons filling a vacated councilman's <br />office shall hola office only during the unexpired term and shall dur- <br />ing such incumbency be entitled to the salary thereto attached. 6 In <br />tine- e�eat- a -tle- mete- s�iell- result- l�- fllll�g- a- �raeas.e�; -t3�e- gayer -e� <br />the -elt�- smell- east - the- e�eelellag- mete - -6 <br />SECTION II. Chapter 2, Article 1, Section 2 -6(f) of the Munici- <br />pal Code od the City of South Bend, Indiana, is hereby amended to read <br />as follows: <br />(f) The Vice - President shall possess the powers and perform the <br />duties of the President of the Council when the President is absent, while <br />tine- Presle�ent- ls- eetlrte} -ss- Meier, or when a temporary vacancy occurs in <br />the Office of the President. <br />SECTION III. Chapter 2, Article 1, Section 2 -10(f) of the Muni- <br />cipal Code of the City of South Bend, Indiana, is hereby amended to <br />read as follows: <br />(f) Responsibilities and Scope of Council Committees. The gene- <br />ral responsibilities of each Council Committee shall include the right <br />to review all legislative proposals, reports and other pertinent infor- <br />mation under its jurisdiction; and to monitor on a continuing basis the <br />department, bureaus and public officials under its jurisdiction. Each <br />Council Committee shall report periodically to the Council, with a mini- <br />mum of send- annual written reports being given by each committee. All <br />committees shall also deal with the issues referred to them by the Pre- <br />sident of the Council or by at least a majority of the Council. <br />
