Johnson, Executive Director <br />Area Plan Commission <br />IN RE: Legal Description, Ordinance 6310 -78, For the LaSalle Square Project <br />A review of the legal description rezoning the subject property, indicates <br />two drafting errors were committed in preparing this description. These <br />errors were not discovered until the City's zoning was being updated. <br />The errors are as follows: <br />Part II and III of the Ordinance states, 'part of Lot No. 176 <br />in Westchester 2nd Unit Addition to the City of South Bend'. <br />Part III of the Ordinances states, 'Lots Numbered 177 through <br />183 in Westchester lst Addition to the City of South Bend', <br />That part of said Lot No. 176, which was intended to be rezoned is, 'That <br />part of Lot No. 176 in Westchester 2nd Unit Addition to the City of South <br />Bend, located at the Southeast corner of Prast Boulevard and Ardmore Trail'. <br />The reason that only a part of said Lot No. 176 was rezoned is that Prast <br />Boulevard along the South boundary of said Lot Mo. 176 was vacated and <br />realignment through said Lot No. 176. <br />That part of said Lot No. 176 located at the Southwest corner of Prast <br />Boulevard and Ardmore Trail, was intended to remain zoned "E" Heavy <br />Industrial. <br />Part III refers to Westchester 1st Addition to the City of South Bend. There <br />is no such subdivision in the City of South Bend. The correct name of the <br />subdivision for the subject property is Westchester 2nd Unit Addition to <br />the City of South Bend. <br />The intent of the legal description describing the land to be rezoned is <br />very clear and supported by the site plan, <br />Serving: South Bend, Lakeville, New Carlisle, North Liberty, Roseland & St. Joseph, County, IN <br />
