REGULAR MEETING <br />COMMUNICATION (Cont.) <br />April 2, 1957 <br />To members of City Council: <br />APRIL 8, 1957 <br />Inasmuch as Governor Handley's Gas Tax has gone into effect, Wouldn't it be a good time to put pressure on him for <br />the north -south truck by -pass? <br />I believe this was to be financed through this tax. <br />Thank You. <br />R. Motion carried. <br />PETITION <br />Petition of Steve A. Krause, et al, to rezone Lots, 1, 2, 3 and 4 in Mayr's Michigan Avenue Addition from B use and A <br />Height and Area to C Commercial Use and E Height and Area District. <br />Councilman Erler made a motion that the Petition be referred to the City Planning Commission. Councilman Kroll <br />seconded the motion. Motion carried. <br />REPORT OF ORDINANCE COMMITTEE: <br />Report of- Ordinance Committee on Ordinance amending several sections of Ordinance No. 3893 on Heating. Councilman <br />Carr, Chairman,,reported that the Ordinance is still in Committee. <br />REPORT OF COMMITTEE OF THE WHOLE: <br />To the Common- Gouncil of the City of South Bend: <br />Your Committee of the Whole, to whom was referred AN ORDINANCE APPROPRIATING FROM THE GENERAL FUND THE SUM OF <br />$1650.00 TO OFFICE OF THE CITY JUDGE, ACCOUNT E -11, SALARY OF TRAFFIC CLERK (4) ALL OF THE BUDGET FOR THE CIVIL CITY <br />O SOUTH BEND, INDIANA, FOR 1957, AND DECLARING AN EXTRAORDINARY EMERGENCY, <br />and . <br />Respectfully report that they have examined the matter /that in their opinion it should be reported as favorable. <br />E /s/ G. Councilman Kroll seconded the motion. <br />Motion carried. <br />(ORDINANCE NO. 4155 <br />AN ORDINANCE APPROPRIATING FROM THE GENERAL FUND THE SUM OF $1650.00 TO OFFICE OF THE CITY JUDGE, <br />ACCOUNT Erll, SALARY OF TRAFFIC CLERK (4), ALL OF THE BUDGET FOR THE CIVIL CITY OF SOUTH BEND, <br />=_ INDIANA, FOR 1957, AND DECLARING AN EXTRAORDINARY EMERGENCY. <br />IThe Ordinance was given third reading and passed by a roll call vote of 9 ayes, O nays,. <br />(REPORT OF CITY PLANNING COMMISSION: <br />Honorable Common Council <br />City of South Bend, <br />South Bend, Indiana <br />!Gentlemen: <br />5 April 1957 <br />The attached petition of Associates Investment Company to rezone land at the intersection of Esther and Ruskin Streets <br />from "B" Residential use District and "A" Height and Area District to "D" Light Industrial Use District and "E" Height <br />and Area District being: <br />Lots 1, 2 and 3 in John Adams First Addition located-at the northeast corner of Ruskin and Esther Streets, <br />AND <br />Also a tract of land south of Ruskin Street, to -wit: <br />Commencing on the south line of Ruskin Street at a point 136 feet East of the east line of Esther Street, <br />thence South 297 feet; thence East 332.45-feet;'thence North 297 feet to the south line of Ruskin Street, thence <br />West 333.46 feet, more or less, along the south-line of Ruskin Street to the place of beginning. <br />This petition was legally advertised under date of 25 March 1957 and given public hearing under date of 4 April 1957. <br />The following action was taken: <br />After due consideration the Commission found that the general area south of Ruskin Street is residential as to <br />use and zoning, that the subject area is adequate in size, shape and area for residential development; that <br />light industrial use of subject area would be an unwarranted and unjustifiable intrusion into a residential <br />area; that no general neighborhood need was shown for increased industrial land and that in fact, ample <br />industrial land suitable for the purpose proposed in Associates Investment Company petition existed in the light <br />industrially zoned tract north of Ruskin Street. <br />The Commission further found that aforesaid Lots 1, 2, and 3 of John Adams First Addition are in a block which <br />is predominately zoned for light industrial purposes and that the best use of said land would be light industrial <br />It was therefore mooed by Mr. Van DeVeire, seconded by Mr. Muszynski that the Planning Commission recommend Lots <br />1, 2, and 3.of John Adams First Addition favorably to the Common Council and further that petition area south <br />of Ruskin Street be unfavorably recommended. ) tL <br />(Remonstrance petition with 30 signatures is attached to the petition. <br />II Very truly yours, <br />CITY PLANNING COMMISSION <br />/s/ Robert L.
