1199 <br />COMMITTEE OF THE WHOLE MEETING JANUARY 14, 1957 <br />Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Committee of the Whole in the <br />Council Chambers, Monday, January 14, 1957, at 8:16 P.M., with all members present except Councilman Hahn. Council- <br />man Carr, Chairman, Presided. <br />ORDINANCE <br />AN ORDINANCE APPROPRIATING FROM THE GENERAL FUND $75.00 TO OFFICE OF THE CITY JUDGE, ACCOUNT E -13, <br />PAUPER ATTORNEY, ALL OF THE BUDGET FOR THE CIVIL CITY OF SOUTH BEND, INDIANA, FOR 1956, AND DECLARING <br />AN EXTRAORDINARY EMERGENCY. <br />The above Ordinance was called out of Committee. Proponents and opponents were given an opportunity to be heard on <br />this matter. City Attorney Irving Smith stated that, in his opinion, the City Judge could mandate the City to pay <br />Attorney fees for Pauper Attorneys, <br />Councilman Korpal made a motion that the Committee of the Whole recommend to the Council that the present Ordinance <br />be withdrawn. Councilman Kroll seconded the motion. Motion carried. <br />Councilman Korpal made a motion that the Committee of the Whole recommend to the Council that the Ordinance Committee <br />meet with the City Attorney and the City Judge in order to draft an Ordinance that would cover Pauper Attorney Fees <br />for the entire year instead of for each individual case. Councilman Muszynski seconded the motion. Motion carried. <br />There being no further business before the Committee of the Whole, Councilman Muszynski made a motion to adjourn. <br />Councilman Erler-,seconded the motion.
