REGULAR MEETING AUGUST 8TH, 1955 <br />i <br />Councilman Hahn made a motion that the Ordinance be amended as follows: "that Line 2 of Section 2 of the <br />Ordinance be amended to read: "The words "is hereby levied" be deleted and the following words be substituted <br />therefor: "is hereby ordered levied in the tax levy of 1956 ". Councilman Glass seconded the motion. Motion <br />carried. <br />ORDINANCE NO. 4057 (AS AMENDED) <br />AN ORDINANCE ESTABLISHING A CUMULATIVE SINKING FUND <br />TO BE KNOWN AS THE TRACK ELEVATION FUND UNDER CHAPTER <br />192 OF THE ACTS OF 1955, GENERAL ASSEMBLY OF THE STATE <br />OF INDIANA. <br />The ordinance, as amended, was given third reading and passed by a roll call vote of 7 ayes (Councilmen Erler, <br />Korpal, Pinter, Bestle, Niezgodski, Glass and Hahn) - 1 nay (Councilman Muszynski). <br />REPORT OF CITY PLAN COMMISSION <br />Honorable Common Council <br />City of South Bend <br />South Bend, Indiana <br />Gentlemen: <br />August 5, 1955 <br />The attached petition of Colpaert Realty Corporation to rezond 20 acre parcel of land located in vicinity of <br />Ford Street and Lombardy Drive was legally advertised under date of July 25, 1955, and given public hearing on <br />August 4, 1955. <br />This petition 'to rezone would, in effect/remove commercial land next to the Pierre Navarre School, said land <br />reverting to residential use, and increase desirability of commercially zoned land by the addition of Tracts <br />A and B. <br />The Board found that the general welfare would be served by the granting of the petition, that a public school <br />serves residential land uses and is far better located on a site which is surrounded by said residential uses, <br />as opposed to commercial or industrial uses. Motion carried. <br />ORDINANCE NO. 4058 <br />AN ORDINANCE AMENDING ORDINANCE NO. 3702, ADOPTED <br />JUNE 13, 1949, AND COMMONLY KNOWN AS THE ZONING <br />ORDINANCE OF THE CITY OF SOUTH BEND. <br />(20 Acre parcel of land in vicinity of Ford <br />Street and Lombardy Drive) <br />The ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion <br />for suspension of rules. Councilman Korpal seconded the motion. Motion carried by a roll call vote of 8 ayes - <br />0 nays. <br />The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays. <br />ORDINANCE <br />AN ORDINANCE TRANSFERRING AND APPROPRIATING FROM STREET <br />AND TRAFFIC FUND, STREET DEPARTMENT S -724 MOTOR EQUIPMENT <br />$12,000.00 TO STREET DEPARTMENT S -43 MATERIALS (STREET AND <br />ALLEY) $12,000.00; FROM GENERAL FUND, SEWER DEPARTMENT <br />SERVICES CONTRACTUAL J -262 REPAIRS TO SEWER REPLACEMENT <br />$2,250.00 TO OFFICE OF CONTROLLER, SERVICES CONTRACTUAL <br />B -262 OTHER CONTRACTUAL SERVICES $2,250.00; ALL OF THE <br />BUDGET FOR THE CIVIL CITY OF SOUTH BEND, INDIANA FOR 1955 <br />AND DECLARING AN EXTRAORDINARY EMERGENCY. <br />The ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion <br />that the ordinance be referred to the Committee of the Whole for public hearing on August 22nd. Councilman Hahn <br />seconded the motion. Motion carried. <br />Councilman Niezgodski made a motion that the Ordinance be amended to designate "Street and Traffic Fund" in line <br />2 of the title before the words "Street Department and "General Fund" be inserted before the words "Sewer Depart - <br />ment" in line 6 of the title of the Ordinance and that the same amendment be made in Section I of the Ordinance. <br />Councilman Hahn seconded the motion. Motion carried. <br />There being no further business before the Council, Councilman Korpal made a motion to adjourn, which motion <br />was seconded by Councilman Hahn.
