REGULAR MEETING AUGUST 8TH, 1955 i Councilman Hahn made a motion that the Ordinance be amended as follows: "that Line 2 of Section 2 of the Ordinance be amended to read: "The words "is hereby levied" be deleted and the following words be substituted therefor: "is hereby ordered levied in the tax levy of 1956 ". Councilman Glass seconded the motion. Motion carried. ORDINANCE NO. 4057 (AS AMENDED) AN ORDINANCE ESTABLISHING A CUMULATIVE SINKING FUND TO BE KNOWN AS THE TRACK ELEVATION FUND UNDER CHAPTER 192 OF THE ACTS OF 1955, GENERAL ASSEMBLY OF THE STATE OF INDIANA. The ordinance, as amended, was given third reading and passed by a roll call vote of 7 ayes (Councilmen Erler, Korpal, Pinter, Bestle, Niezgodski, Glass and Hahn) - 1 nay (Councilman Muszynski). REPORT OF CITY PLAN COMMISSION Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: August 5, 1955 The attached petition of Colpaert Realty Corporation to rezond 20 acre parcel of land located in vicinity of Ford Street and Lombardy Drive was legally advertised under date of July 25, 1955, and given public hearing on August 4, 1955. This petition 'to rezone would, in effect/remove commercial land next to the Pierre Navarre School, said land reverting to residential use, and increase desirability of commercially zoned land by the addition of Tracts A and B. The Board found that the general welfare would be served by the granting of the petition, that a public school serves residential land uses and is far better located on a site which is surrounded by said residential uses, as opposed to commercial or industrial uses. It was, therefore, moved, seconded, and carried that the petition be favorably recommended to the Council. Very truly yours, CITY PLANNING COMMISSION Robert L. ORDINANCE NO. 4058 AN ORDINANCE AMENDING ORDINANCE NO. 3702, ADOPTED JUNE 13, 1949, AND COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND. (20 Acre parcel of land in vicinity of Ford Street and Lombardy Drive) The ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion for suspension of rules. Councilman Korpal seconded the motion. Motion carried by a roll call vote of 8 ayes - 0 nays. The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays. ORDINANCE AN ORDINANCE TRANSFERRING AND APPROPRIATING FROM STREET AND TRAFFIC FUND, STREET DEPARTMENT S -724 MOTOR EQUIPMENT $12,000.00 TO STREET DEPARTMENT S -43 MATERIALS (STREET AND ALLEY) $12,000.00; FROM GENERAL FUND, SEWER DEPARTMENT SERVICES CONTRACTUAL J -262 REPAIRS TO SEWER REPLACEMENT $2,250.00 TO OFFICE OF CONTROLLER, SERVICES CONTRACTUAL B -262 OTHER CONTRACTUAL SERVICES $2,250.00; ALL OF THE BUDGET FOR THE CIVIL CITY OF SOUTH BEND, INDIANA FOR 1955 AND DECLARING AN EXTRAORDINARY EMERGENCY. The ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion that the ordinance be referred to the Committee of the Whole for public hearing on August 22nd. Councilman Hahn seconded the motion. Motion carried. Councilman Niezgodski made a motion that the Ordinance be amended to designate "Street and Traffic Fund" in line 2 of the title before the words "Street Department and "General Fund" be inserted before the words "Sewer Depart - ment" in line 6 of the title of the Ordinance and that the same amendment be made in Section I of the Ordinance. Councilman Hahn seconded the motion. Motion carried. There being no further business before the Council, Councilman Korpal made a motion to adjourn, which motion was seconded by Councilman Hahn.
