COMMITTEE OF THE WHOLE MEETING <br />APRIL 11TH, 1955 <br />I C56 <br />Be it remembered that the Common Council of the City of South Bend met in the Committee of the Whole meeting in <br />the Council Chamber, Monday, April 11th, 1955, at 8:11 P.M. (E.S.T.), with all members present. Chairman Hahn <br />presided. <br />ORDINANCE NO. 4037 <br />"An Ordinance amending Ordinance No. 3702 commonly known as the Zoning Ordinance of the City of South Bend, <br />Indiana." (19 Acres - Riverside Drive). <br />Mr. Joseph Hemphling and Mr. F. R. Henrekin appeared for the proponents, and Mr. Dan Richardson represented <br />several hundred who were opposed to this rezoning. <br />Councilman Glass made a motion that the ordinance be reported to the.Council as favorable. Councilman Muszynski <br />seconded the motion. Motion carried. <br />Councilman Erler made a motion that the ordinance be amended as follows: <br />"That the 19 acre ordinance be amended as follows: That Queen Street be extended <br />East full width to the east line of Sherman Avenue, that Sherman Avenue be extended <br />full width south to south side of Queen Street. The north boundary of industrial <br />zoning extend north to first alley north of Queen Street." <br />Lock Joint Tube Company be requested to continue the 100 foot setback along Riverside <br />Drive for drive, full length of industrial zoned property. <br />This amendment affords approximately 6 -1/2 acres of industrial property with a possible <br />additional acreage for transitional:use_ for parking." <br />Councilman Bestle seconded the motion. The motion to amend was lost by roll call vote of 3 ayes (Councilmen <br />Erler, Bestle and Hahn) - 5 nays (Councilmen Korpal, Pinter, Niezgodski, Glass and Muszynski). <br />The ordinance was reported to the Council as favorable. Motion carried by a roll call vote of 5 ayes (Councilmen <br />Korpal, Pinter, Niezgodski, Glass and Muszynski) - 3 nays (Councilman Erler, Bestle and Hahn). <br />There being no further business before the Committee of the Whole, Councilman Niezgodski made a motion to <br />adjourn, which motion was seconded by Councilman Muszynski.
