President Erler presided* <br />REPORT OF COMMITTEE ON MINUTES <br />To the Common Council of the City of South Bend: <br />Your Committee on the inspection and supervision of the minutes, would respectfully report that they have <br />inspected the minutes of the previous meeting of the Council and found them correct. Councilman Muszynski seconded the motion. <br />Motion carried* <br />PETITION <br />STATE OF INDIANA ) SS: <br />CITY OF SOUTH BEND ) <br />IN THE MATTER OF THE REZONING OF PART <br />OF AN AREA BOUNDED BY BENDIX DRIVE, LINCOLN <br />WAY WEST,,, KENMORE STREET AND THE CITY LIMITS• <br />Petitioners alleges <br />PETITION OF SOUTH BEND SAND AND GRAVEL <br />CORPORATION, LOUIS GRUSZYNSKI AND <br />PELAGIA KANIEMKI. <br />1. South Bend Sand and Gravel Corporation is the owner in fee simple of a tract bounded by a line running <br />as follows: <br />Commencing at a point of intersection of the center lines of Kenmore Street and Marquette <br />Boulevard produced; thence North to the City Limits; thence East to Bendix Drive; thence <br />South to the center line of Marquette Boulevard produced; thence West to the place of <br />beginning; which tract for convenience is called Parcel le <br />2. Louis Gruszynski and Pelagia Kaniewski are collectively the owners in fee simple of two tracts, which for <br />convenience are called Parcels 2 and 3, to wit: <br />IN <br />Parcel 2 is bounded by a line running as followsr. Commencing; at the point of intersection <br />of t ; he center lines of Kenmore Street and Marquette Boulevard produced thence East to <br />Bendix Drive; thence South to the center line of Elwood Avenue produced; thence West to <br />a point 603 feet West of the center line of Bendix Drive; thence North to the center line <br />of Keller Street produced; thence West to the center line of Kenmore Street produced; <br />thence North to the place of beginning. <br />Parcel 3 is bounded by a line running as follows: Commencing at the intersection of <br />;x Bendix Drive and Lincoln Way West; thence Northwesterly along Lincoln Way West to a point <br />712 feet West of the center line of Bendix Drive; thence North to the center line of <br />Elwood Avenue produced; thence East to Bendix Drive; thence South to the place of <br />beginning. <br />39 Except for a small frontage in Parcel 3 at the intersection of Bendix Drive and Lincoln Way West, said <br />three parcels are presently zoned "A" Residential, <br />4. A large area on the East side of Bendix irive opposite said three parcels is zoned for heavy industry <br />and has long been used and is now used for the mining and processing of sand and gravel and the manufacture <br />of concrete and other products* Such area has long been served., and is now being served by the Chicago South <br />Shore and South Bend Railroad.
