791 <br />REGULAR MEETING APRIL 28TH, 1952 <br />REPORT OF COMMITTEE OF THE WHOLE <br />To the Common Council of the City of South Bend: <br />Your Committee of the Whole to whom was referred "An Ordinance reducing certain items in the 1952 budget for the <br />Fire Department of the Civil City of South Bend, Indiana, in the amount of $20,000.00 and for the Cemetery Depart -' <br />ment in the amount of $500.00 and appropriating from the General Fund of said +City to the 1952 budget for said <br />departments in said amounts and declaring an extraordinary emergency". <br />Respectfully report that they have examined the matter and that in their opinion this ordinance go to the Council <br />as favorable. <br />VA. A. HAHN, Chairman <br />Councilman Korpal made a motion that the report be accepted. Councilman Glass seconded the motion. Motion <br />carried. <br />REPORT OF COMMITTEE OF THE WHOLE <br />To the Common Council of the City of South Bend: <br />Your Committee of the 'Whole to whom was referred "An Ordinance appropriating all Parking Meter Fees and Funds <br />to the Board.of Public Works and Safety of the Civil City of South Bend, Indiana, for the uses and purposes set <br />forth therein in accordance with Chapter 236 of the Acts of the General Assembly of the State of Indiana of 1945, <br />as amended by Chapter 303 of the Acts of the General Assembly of 1951 ". <br />Respectfully report that they have examined the matter and that in their opinion this ordinance go to the Council <br />as favorable. <br />WM. Motion <br />carried. <br />ORDINANCE NO. 3867 <br />AN ORDINANCE REDUCING CERTAIN ITEMS IN THE 1952 <br />BUDGET FOR THE FIRE DEPARTMENT OF THE CIVIL CITY <br />OF SOUTH BEND, INDIANA, IN THE AMOUNT OF $20,000.00 <br />AND FOR THE CEMETERY DEPARTMENT IN THE AMOUNT OF <br />$500.00 AND APPROPRIATING FROM THE GENERAL FUND OF <br />SAID CITY TO THE 1952 BUDGET FOR SAID DEPARTMENTS <br />IN SAID AMOUNTS AND DECLARING AN EXTRAORDINARY <br />EMERGENCY. <br />The ordinance�Ams given third reading and passed by a roll call vote of 8 ayes - 0 nays - 1 absent (Pinter). <br />ORDINANCE NO. 3868 <br />AN ORDINANCE APPROPRIATING ALL PARKING METER FEES AND FUNDS <br />TO THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CIVIL CITY OF <br />SOUTH BEND, INDIANA, FOR THE USES AND PURPOSES SET FORTH THEREIN <br />IN ACCORDANCE WITH CHAPTER 236 OF THE ACTS OF THE GENERAL ASSEMBLY <br />OF THE STATE OF INDIANA OF 1945, AS AMENDED BY CHAPTER 303 OF THE <br />ACTS OF THE GENERAL ASSEMBLY OF 1951. <br />The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays - 1 absent (Pinter). <br />ORDINANCE <br />AN ORDINANCE AMENDING ORDINANCE NO. 3702 COMMONLY <br />KNOWN AS THE 'ZONING ORDINANCE. <br />(Property is on the south side of McKinley Ave. <br />east of but not touching upon Ironwood Drive) <br />President Erler called on the proponents to speak, and Mr. Robert A. Grant, Attorney for Louis Major, Jr., <br />informed the Council that the petitioner intended to occupy only twenty"-five per cent of the four and one -half <br />acres involved with buildings, and use the remainder for off - street parking and that the buildings would be <br />modern and in keeping with the community and not lead to a decline in real estate values but enhance them. <br />The - following also spoke: <br />Professor J. B. Searles, marketing teacher in the University of Notre Dame college of commerce and Forest J. <br />Armstrong, 332 North Ironwood jPrive spoke in behalf of Messrs. Wekony, Fisher, Gallanteen, Hess and Cissne. <br />The opposition group was also heard and consisted of the following: <br />Mr. William Shanahan, 113 North Ironwood Drive; Clyde Reynolds, 217 North Ironwood Drive; Irving J. Smith, <br />2116 E. Bader Ave., Albert H. Rerrick, 822 E. Donald, Trustee of the First Brethren Church, Ironwood Drive at <br />Washington and Orie Parker and George M. Eichler, Attorneys. They indicated that the residents in that vicinity <br />were not in favor of the shopping center and pleaded to the Council to defeat the ordinance for rezoning. <br />The ordinance was given third reading and lost by a roll call vote of 0 ayes - 7 nays (Erle r, Alford, Korpal, <br />Bestle, Niezgodski, Hahn and Muszynski) - 1 Not Voting (Glass) - 1 absent (Pinter). <br />
