JEFFERSON BLVD., ROOM 1140 COUNTY -CITY BUILDING, SOUTH SEND, INDIANA 46601 (574) 23S -9571 <br />April 23, 2013 <br />City of South Bend <br />Board of Public Works <br />13"' Floor, County -City Building <br />South Bend, Indiana 46601 <br />RE: Street/Alley Vacation <br />Applicant: St Joseph County Public Library <br />Location: First North /South Alley (Ostego Street) East of Main Street between Wayne Street and <br />Western Avenue <br />Dear Board Members: <br />The staff has reviewed this petition. It is the staff's opinion that: <br />(1) The vacation would not hinder the growth or orderly development of the unit or neighborhood in which it <br />is located or to which it is contiguous. <br />It is the staff's understanding that the street is purposed to be vacated for future development of the St. <br />Joseph County Public Library. <br />(2) The vacation would not make access to the lands of the aggrieved person by means of public way difficult <br />or inconvenient. <br />The petitioner owns, according to most recent tax records, approximately 75% of the property abutting <br />the street/alley. <br />(3) The vacation would not hinder the public's access to a church, school, or other public building or place. <br />The street does access a public building or place, the St. Joseph County Public Library, however, since <br />the SJCPL is the petitioner, access to their property will not be hindered. <br />(4) The vacation would not hinder the use of a public way by the neighborhood in which it is located or to <br />which it is contiguous. <br />There will still be access to the site from Main or Michigan Streets. <br />Due to the above stated reasons, the staff recommends that the proposed street vacation be approved. <br />Please contact our office if you have any questions or need any additional information. <br />Sincerely, <br />ek,v &'67hf <br />Christa Nayder, Planner <br />SERVING ST.
