REGULAR MEETING <br />ORDINANCE NO. 3857 <br />AN ORDINANCE AMENDING ORDINANCE NO. 37029 COMMONLY KNOWN <br />AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA. <br />(Northwest corner of Falcon and Washington Streets) <br />JANUARY 14TH. 1952 <br />160 <br />The ordinance was given first reading by title and second reading in full. Councilman Glass made a motion for <br />suspension of rules. Councilman Hahn seconded the motion. Motion carried by a roll call vote of 9 ayes - 0 nays. <br />The ordinance was given third reading and passed by a roll call vote of 9 ayes - 0 nays. <br />ORDINANCE <br />AN ORDINANCE APPROPRIATING FROM THE GENERAL FUND THE SUM OF <br />SIXTEEN HUNDRED EIGHTY ($10680.00) DOLLARS TO CERTAIN BUDGETARY <br />ITEMS OF THE 1952 BUDGET OF THE CIVIL CITY OF SOUTH BEND, INDIANA, <br />AND DECLARING AN EXTRAORDINARY EMERGENCY. <br />The ordinance was given first reading by title and second reading in full. Councilman Glass made a motion that <br />the ordinance be referred to the Committee of the Whole for public hearing on January 28th, 1952, at 8:00 P.M. <br />Councilman Niezgodski seconded the motion. Motion carried. <br />ORDINANCE <br />AN ORDINANCE REDUCING CERTAIN STEMS IN THE 1952 BUDGET FOR <br />THE POLICE DEPARTMENT OF THE CIVIL CITY OF SOUTH BEND, INDIANA, <br />IN THE AGGREGATE AMOUNT OF $17,906.00 AND APPROPRIATING FROM <br />THE GENERAL FUND OF SAID CITY TO THE 1952 BUDGET FOR THE POLICE <br />DEPARTMENT OF SAID CITY IN THE AGGREGATE AMOUNT OF $170P898.00 <br />AND 'DECLARING AN EXTRAORDINARY EMERGENCY. <br />The ordinance was given first reading by title and second reading in full. Councilman Bestle made a motion <br />that the ordinance be referred to the Committee of the Whole for public hearing on January 28th, 1952, at 8:00 <br />P.M. Councilman Hahn seconded the motion. Motion carried. <br />RESOLUTION <br />BE IT RESOLVED by the Common :Council of the City of South Bend, Indiana: <br />That pursuant to Section 1 of Chapter 127 of the 87th Session (1951) of the General Assembly of the State of <br />Indiana, the full time and /or part time deputies appointed by the City Clerk of South Bend, Indiana, at the <br />salaries set forth in the Municipal Civil City budget of said City for the year 1952 are herein in all things <br />approved and ratified. <br />Walter C. Erler, Sr. <br />Member of the Common Council <br />Councilman Hahn made a motion that the resolution be adopted. Councilman Muszynski seconded the motion. Motion <br />carried. <br />PROCEDURE OF CITY PLAN PETITIONS <br />There is considerable delay encountered from the time a petition for a change to zoning is given to the City <br />Clerk, then presented to the Council at next regular meeting, referred from the Council to the 'Plan Commission <br />(which is a matter 'of routine) . <br />After Plan Commission receives petition ten days is required for notice of public hearing after which Plan <br />Commission recommendations are referred back to the City Council. <br />As an example: The delay could be from January 14th when petition is given to City Clerk to March 31st with the <br />normal procedure. I, therefore, move that when a petition is presented to the City Clerk a duplicate copy <br />immediately be given to the Plan Commission so that the Plan Commission can make provi -sion for the public hearing <br />at the earliest possible date. <br />Councilman Hahn made a motion that the above procedure be adopted. -Councilman Bestle seconded the motion. <br />Motion carried. <br />ORDER OF BUSINESS <br />In order that the City Council may more thoroughly identify tk:e location of property to be zoned in the various <br />zoning ordinances, I move that the Plan Commission's report tothe Council describe the location of property <br />affected by street and house numbers to be read first preceding the ordinance to which it refers. <br />The description and location of property to be zoned in the ordinance is in technical language of which the layman <br />is unfamiliar. <br />Councilman Bestle made a motion that the Order of Business be adopted. Councilman Niezgodski seconded the <br />motion. Motion carried. <br />NEW BUSINESS <br />Councilman Glass made a motion that the question of street parking be referred to the Streets and Alleys <br />Committee and the advice of the City Attorney relative to an ordinance. Councilman Niezgodski seconded the <br />motion. Motion carried. <br />(Continued) <br />
