sJ <br /> REGULAR MEETING JULY 26, 2004 <br /> within the corporate boundaries of the City of South Bend regardless of similar topography,patterns <br /> of land use, or population density. <br /> Section III. That the Board of Public Works shall and does hereby now establish and adopt <br /> the Fiscal Plan, attached hereto as Exhibit "A", and made a part hereof, for the furnishing of said <br /> services to the territory to be annexed, which provides, among other things, that a sanitary sewer <br /> main line is available in the Jewel Park subdivision sufficient to service this annexation area with <br /> any extension of the main line to and through the proposed subdivision to be at the developer's <br /> expense; that a twelve inch water main is available at the northwest corner of Jackson Road and <br /> Main Street, and the developer and City will share equally the expense to extend necessary water <br /> lines to and through the proposed subdivision; that street lighting will be required within the <br /> subdivision to be installed and paid for by the developer; and that new public streets will also be <br /> constructed by the developer at its expense. <br /> Adopted at a meeting of the Board of Public Works of the City of South Bend, Indiana, on <br /> this 26thth day of July, 2004. <br /> BOARD OF PUBLIC WORKS OF THE <br /> CITY OF SOUTH BEND, INDIANA <br /> s/Gary A. Jacob, Clerk <br /> APPROVAL OF RECOMMENDATION TO ENCROACH ONTO PUBLIC RIGHT-OF-WAY - <br /> NATIONAL CITY BANK <br /> Mr. Gilot advised that the Board is in receipt of favorable recommendations from the Division of <br /> Engineering, Police Department, Building Commissioner and the Redevelopment Design Review <br /> Committee for encroachment at National City Bank, 4501 South Michigan Street, South Bend, <br /> Indiana. Upon a motion made by Mr. Gilot, seconded by Mr. Littrell and carried, the <br /> recommendation was approved. <br /> APPROVAL OF RECOMMENDATION TO ENCROACH ONTO PUBLIC RIGHT-OF-WAY - <br /> MAXI'S RESTAURANT <br /> Mr. Gilot advised that the Board is in receipt of favorable recommendations from the Division of <br /> Engineering, Police Department, Building Commissioner and the Redevelopment Design Review <br /> Committee for encroachment at 114 West Ireland Road,South Bend,Indiana. Upon a motion made <br /> by Mr. Gilot, seconded by Mr. Littrell and carried, the recommendation was approved. <br /> APPROVE DRILLING PERMIT <br /> Upon a motion by Mr. Gilot, seconded by Mr. Littrell and carried,the following drilling permit was <br /> approved: <br /> Location CQ= Comments <br /> Adjacent to 5301 Nimtz EnviroCorp., Inc. All Criteria Has Been Met <br /> Parkway <br /> RELEASE OF UTILITY EASEMENT - STUDEBAKER NATIONAL MUSEUM - DANCH <br /> HARNER& ASSOCIATES - PROJECT NO. 103-072 <br /> Upon a motion made by Mr. Littrell, seconded by Mr. Gilot and carried, the above referred to <br /> easement was approved. This easement is for a field inspection of a portion of Jefferson Boulevard, <br /> west of Chapin Street for a proposed alley vacation and a public alley running north off the proposed <br /> vacated portion of Jefferson Boulevard to build the Studebaker Museum over a portion of the <br /> proposed vacated right-of-ways. <br />
