REGULAR MEETING JULY 26, 2004 Agreement- Building Block 1317 E. Miner $125.00 - General Fund Grant Agreement Agreement - Building Block 1322 King Street $125.00 - General Fund Grant Agreement Agreement - Building Block 2818 Edison Road $125.00 - General Fund Grant Agreement Agreement - Building Block 608 S. St. Joseph Street $1,500.00 - General Fund Grant Agreement Upon a motion made by Mr. Gilot, seconded by Mr. Littrell and carried, the above referred to Contracts were approved and executed. RATIFY CONSTRUCTION CONTRACT-PARKING STRUCTURE NO. 1 PHASE 2A-KASER SPRAKER CONSTRUCTION, INC. - PROJECT NO. 104-019(TIF) Mr. Gilot advised that in accordance with the bid awarded on June 28, 2004, to Kaser Spraker Construction, Inc., in the amount of$2,869,375.00 for the above referred to project, a Contract in said amount was being submitted for Board approval. Upon a motion made by Mr. Gilot, seconded by Mr. Littrell and carried, the Contract was approved and the appropriate Certificate of Insurance was filed. It was noted that the Contract was approved on June 28,2004,pursuant to Resolution No. 100-2000. APPROVE CONSENT TO ANNEXATION AND WAIVER OF RIGHTS TO REMONSTRATE- 51640 MEADOW POND DRIVE - SEWER ONLY Mr. Gilot stated that the Board is in receipt of a Consent to Annexation and Waiver of Right to Remonstrate as submitted by Mr.and Mrs.Robert and Mary Ann Konopa, 17519 Green Oaks Court, Granger, Indiana. The Consent indicates that in consideration for permission to tap into the public sanitary sewer system of the City, to provide sanitary sewer service to 51640 Meadow Pond Drive, South Bend, Indiana, Key No. 02-2013-0263, the Konopas waive and release any and all right to remonstrate against or oppose any pending or future annexation of the property by the City of South Bend. Therefore,Mr. Gilot made a motion that the Consent be approved. Mr. Littrell seconded the motion which carried. APPROVE CONSENT TO ANNEXATION AND WAIVER OF RIGHTS TO REMONSTRATE- 53125 NADINE STREET - SEWER AND WATER Mr. Gilot stated that the Board is in receipt of a Consent to Annexation and Waiver of Right to Remonstrate as submitted by Mr. and Mrs. Dan A. and Karen J. Kagarise, 1540 Arcadia Avenue, South Bend, Indiana. The Consent indicates that in considerations for permission to tap into the public water and sanitary sewer system of the City, to provide water and sanitary sewer service to 53125 Nadine Street, South Bend,Indiana,Key No. 02-1020-4442,the Kagarises waive and release any and all right to remonstrate against or oppose any pending or future annexation of the property by the City of South Bend. Therefore,Mr. Gilot made a motion that the Consent be approved. Mr. Littrell seconded the motion which carried. APPROVE CONSENT TO ANNEXATION AND WAIVER OF RIGHTS TO REMONSTRATE- 51690 IRONWOOD ROAD - WATER Mr. Gilot stated that the Board is in receipt of a Consent to Annexation and Waiver of Right to Remonstrate as submitted by First Church of the Nazareen, 51690 Ironwood Road, South Bend, Indiana. The Consent indicates that in considerations for permission to tap into the public water system of the City,to provide water service to 51690 Ironwood Road, South Bend,Indiana,Key No. 02-2013-0257.03, the First Church of the Nazareen waives and releases any and all right to remonstrate against or oppose any pending or future annexation of the property by the City of South Bend. Therefore,Mr. Gilot made a motion that the Consent be approved. Mr. Littrell seconded the motion which carried. ADOPT RESOLUTION NO. 31-2004-A RESOLUTION OF THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND INDIANA ADOPTING A WRITTEN FISCAL PLAN AND
