St. Joseph Street $1,500.00 - General Fund <br /> Grant Agreement <br /> Upon a motion made by Mr. Gilot, seconded by Mr. Littrell and carried, the above referred to <br /> Contracts were approved and executed. <br /> RATIFY CONSTRUCTION CONTRACT-PARKING STRUCTURE NO. 1 PHASE 2A-KASER <br /> SPRAKER CONSTRUCTION, INC. - PROJECT NO. 104-019(TIF) <br /> Mr. Gilot advised that in accordance with the bid awarded on June 28, 2004, to Kaser Spraker <br /> Construction, Inc., in the amount of$2,869,375.00 for the above referred to project, a Contract in <br /> said amount was being submitted for Board approval. Upon a motion made by Mr. Gilot, seconded <br /> by Mr. Littrell and carried, the Contract was approved and the appropriate Certificate of Insurance <br /> was filed. It was noted that the Contract was approved on June 28,2004,pursuant to Resolution No. <br /> 100-2000. <br /> APPROVE CONSENT TO ANNEXATION AND WAIVER OF RIGHTS TO REMONSTRATE- <br /> 51640 MEADOW POND DRIVE - SEWER ONLY <br /> Mr. Gilot stated that the Board is in receipt of a Consent to Annexation and Waiver of Right to <br /> Remonstrate as submitted by Mr.and Mrs.Robert and Mary Ann Konopa, 17519 Green Oaks Court, <br /> Granger, Indiana. The Consent indicates that in consideration for permission to tap into the public <br /> sanitary sewer system of the City, to provide sanitary sewer service to 51640 Meadow Pond Drive, <br /> South Bend, Indiana, Key No. 02-2013-0263, the Konopas waive and release any and all right to <br /> remonstrate against or oppose any pending or future annexation of the property by the City of South <br /> Bend. Therefore,Mr. Gilot made a motion that the Consent be approved. Mr. Littrell seconded the <br /> motion which carried. <br /> APPROVE CONSENT TO ANNEXATION AND WAIVER OF RIGHTS TO REMONSTRATE- <br /> 53125 NADINE STREET - SEWER AND WATER <br /> Mr. Gilot stated that the Board is in receipt of a Consent to Annexation and Waiver of Right to <br /> Remonstrate as submitted by Mr. and Mrs. Dan A. and Karen J. Kagarise, 1540 Arcadia Avenue, <br /> South Bend, Indiana. The Consent indicates that in considerations for permission to tap into the <br /> public water and sanitary sewer system of the City, to provide water and sanitary sewer service to <br /> 53125 Nadine Street, South Bend,Indiana,Key No. 02-1020-4442,the Kagarises waive and release <br /> any and all right to remonstrate against or oppose any pending or future annexation of the property <br /> by the City of South Bend. Therefore,Mr. Gilot made a motion that the Consent be approved. Mr. <br /> Littrell seconded the motion which carried. <br /> APPROVE CONSENT TO ANNEXATION AND WAIVER OF RIGHTS TO REMONSTRATE- <br /> 51690 IRONWOOD ROAD - WATER <br /> Mr. Gilot stated that the Board is in receipt of a Consent to Annexation and Waiver of Right to <br /> Remonstrate as submitted by First Church of the Nazareen, 51690 Ironwood Road, South Bend, <br /> Indiana. The Consent indicates that in considerations for permission to tap into the public water <br /> system of the City,to provide water service to 51690 Ironwood Road, South Bend,Indiana,Key No. <br /> 02-2013-0257.03, the First Church of the Nazareen waives and releases any and all right to <br /> remonstrate against or oppose any pending or future annexation of the property by the City of South <br /> Bend. Therefore,Mr. Gilot made a motion that the Consent be approved. Mr. Littrell seconded the <br /> motion which carried. <br /> ADOPT RESOLUTION NO. 31-2004-A RESOLUTION OF THE BOARD OF PUBLIC WORKS <br /> OF THE CITY OF SOUTH BEND INDIANA ADOPTING A WRITTEN FISCAL PLAN AND <br />
