That the transfer of the Real Property situated in St. Joseph County, Indiana, and generally described as follows; See attached Exhibit"A" by the City of South Bend,Indiana,to the City of South Bend, for use and benefit of its Department of Redevelopment, shall be, and hereby is, approved. 2. That the Mayor of the City of South Bend and the South Bend City Clerk shall be and hereby are, authorized, respectively, to execute and attest to the execution of a quit claim deed conveying all of the right, title and interest of the City of South Bend, Indiana in and to the Real Property to the City of South Bend,for the use and benefit of its Department of Redevelopment. 3. That this Resolution shall be in full force and effect upon its adoption by the Board of Public Works of the City of South Bend. ADOPTED at a meeting of the Board of Public Works of the City of South Bend held on June 28, 2004, at 1316 County-City Building, 227 West Jefferson Boulevard, South Bend, Indiana 46601. Jacob, Clerk APPROVAL OF GRANT OF PERPETUAL EASEMENT - DRAINAGE EASEMENT - WEST EDGE OF TECHNOLOGY WING OF IVY TECH CAMPUS Upon a motion made by Mr. Gilot,seconded by Mr.Inks and carried,the above referred to easement was approved. This easement is for subsurface drainage along Ivy Tech's facility. APPROVE TITLE SHEET - LAFAYETTE FALLS, SECTION I Mr. Gilot advised that the Title Sheet for the above referred to project was being presented at this time for execution. Upon a motion made by Mr. Gilot, seconded by Mr. Inks and carried,the above referred to Title Sheet was approved and signed. APPROVE CONSENT TO ANNEXATION AND WAIVER OF RIGHTS TO REMONSTRATE Mr. Gilot stated that the Board is in receipt of a Consent to Annexation and Waiver of Right to Remonstrate as submitted by Mr. Jeffery Kuroski, 20950 Ireland Road, South Bend, Indiana. The Consent indicates that in consideration for permission to tap into the public sanitary sewer system of the City, to provide sanitary sewer service to 20950 Ireland Road, South Bend, Indiana, (Key 4 01-1014-0302.02), Mr, Kuroski waives and releases any and all right to remonstrate against or oppose any pending or future annexation of the property by the City of South Bend. Therefore,Mr. Gilot made a motion that the Consent be approved. Mr. Inks seconded the motion which carried. FILING OF CERTIFICATES OF INSURANCE Upon a motion made by Mr. Gilot, seconded by Mr. Inks and carried,the following Certificates of Insurance were accepted for filing: Masonry Restoration Specialists, Inc.
