<br /> APPROVAL OF LICENSE APPLICATION FOR SIDEWALK CAFE - LASALLE GRILLE
<br /> Mr. Gilot stated that the Board is in receipt of favorable recommendations from the Fire Department.
<br /> Engineering, Building Department, Police Department and the Legal Department for a License
<br /> Application for a Sidewalk Cafe, as submitted by Mr. Mark McDonnel, LaSalle Grille, 115 West
<br /> Colfax, South Bend,Indiana. The Fire Department stated that if a front gate is to be installed,access
<br /> will be required from the Fire Department in case of an emergencies. Upon a motion made by Mr.
<br /> Inks, seconded by Mr. Gilot and carried, the License Application was approved.
<br /> APPROVAL OF RECOMMENDATION TO PURCHASE/ACQUIRE CITY-OWNED
<br /> PROPERTIES - 1010 WEST JEFFERSON/906 WEST THOMAS - SOUTH BEND HERITAGE
<br /> FOUNDATION
<br /> In a letter to the Board, the South Bend Heritage Foundation, 803 Lincolnway West, South Bend,
<br /> Indiana, indicated their interest in purchasing the above referred to properties for rehabilitation for
<br /> income eligible families. It was noted that South Bend Heritage Foundation will purchase 1010
<br /> West Jefferson in the amount of $29,000.00; 906 West Thomas will be acquired. Favorable
<br /> recommendations were received from the Mayor, Division of Engineering, Code Enforcement,
<br /> Community and Economic Development, Park Department and the Legal Department. Upon a
<br /> motion made by Mr.Inks,seconded by Mr.Littrell and carried,the recommendations were approved.
<br /> APPROVAL OF RECOMMENDATION-TO CONDUCT"COMPANIONS RIVER WALK 2004"
<br /> - FAITH UNITED METHODIST CHURCH
<br /> Mr. Gilot stated that favorable recommendations have been received by Traffic and Lighting, Park
<br /> Department,Police Department and the City Attorney's office,in reference to a request as submitted
<br /> by Ms. Mary Conrad, 802 East Ewing, South Bend, Indiana, to conduct the above referred to walk
<br /> on September 25, 2004, from 8:00 a.m. to 12:00 p.m., on the designated route as submitted. Upon
<br /> a motion made by Mr. Gilot, seconded by Mr. Inks and carried,the recommendation was approved.
<br /> FAVORABLE RECOMMENDATION - PETITION TO VACATE AN ALLEY - FIRST
<br /> EAST/WEST ALLEY SOUTH OF JEFFERSON BOULEVARD
<br /> Mr. Littrell indicated that Mr. Robert Bollman, 218 South St. Peter, South Bend, Indiana, has
<br /> submitted a request to vacate the above referred to alley. Mr. Gilot advised that the Board is in
<br /> receipt of favorable recommendations concerning this Vacation Petition from the Area Plan
<br /> Commission, Police Department, Fire Department, Sanitation, Department of Economic
<br /> Development and the Department of Public Works. Engineering stated that the petitioner should
<br /> come to an agreement with his neighbor concerning access to their properties using each others'
<br /> space on the vacated alleys. Also,they will be responsible for curb,walk, landscape improvements
<br /> necessary to accomplish closure to traffic. In addition, if the alley is vacated, it be vacated subject
<br /> subject to any utility easements that are necessary. Therefore, Mr. Gilot made a motion that the
<br /> Clerk send a letter to the petitioner addressing these concerns. Mr. Inks seconded the motion which
<br /> carried.
<br /> FAVORABLE RECOMMENDATION - PETITION TO VACATE ALLEYS - FIRST
<br /> NORTH/SOUTH ALLEY EAST OF NILES FROM MADISON STREET;FIRST NORTH/SOUTH
<br /> ALLEY EAST OF NILES FROM MADISON STREET TO CEDAR, NORTH/SOUTH
<br /> ALLEY EAST OF NILES FROM CEDAR
<br /> Mr. Littrell indicated that Mr. Bruce Bancroft, Barnes and Thornburg, South Bend, Indiana, has
<br /> submitted a request to vacate the above referred to alleys. Mr. Gilot advised that the Board is in
<br /> receipt of favorable recommendations concerning this Vacation Petition from the Area Plan
<br /> Commission, Police Department, Fire Department, Sanitation, Department of Economic
<br /> Development and the Department of Public Works. Area Plan stated that the petitioner must own
<br /> all the properties contiguous to these rights-of-way. It also appears that this will also create dead-end
<br /> alleys at the north and south points. Engineering stated that Madison Center owns the properties
<br /> on both sides of the alley. South of Madison, other property owners may require access to their rear
<br /> yards. Also a turning capability needs to be established for the"L" shaped alley being created at the
<br /> south end by this vacation. In addition, if these alleys are vacated, they be done so subject to any
<br /> utility easements that are necessary. Therefore, Mr. Inks made a motion that the Clerk send a letter
<br /> to the petitioner addressing these concerns. Mr. Mr. Gilot seconded the motion which carried.
