REGULAR MEETING MAY 24, 2004 <br /> impairing or interfering with the highway or with the free and same flow of traffic, Upon a motion <br /> made by Mr. Gilot, seconded by Mr. Littrell and carried, the Revokable Permit was approved. <br /> APPROVAL OF RECOMMENDATION-TO CLOSE STREET-SOUTH STREET FROM MAIN <br /> TO LAFAYETTE-FIRE TRUCK MUSTER/COMMUNITY CELEBRATION - STUDEBAKER <br /> MUSEUM <br /> Mr. Gilot stated that favorable recommendations have been received by Traffic and Lighting,Police <br /> Department and the City Attorney's office, in reference to a request as submitted by Ms. Rebecca <br /> Bonham, 525 South Main Street, South Bend, Indiana, to conduct the above referred to event on <br /> June 26, 2004, from 7:00 a.m. to 5:00 p.m. Upon a motion made by Mr. Gilot, seconded by Mr. <br /> Littrell and carried, the recommendation was approved. <br /> FAVORABLE RECOMMENDATION-REQUEST TO VACATE AN ALLEY-NEAR 922 EAST <br /> INDIANA AVENUE <br /> Mr. Gilot indicated that Mr. Willis Collins, 922 East Indiana Avenue, South Bend, Indiana, has <br /> submitted a request to vacate the above referred to alley. Mr. Gilot advised that the Board is in <br /> receipt of favorable recommendations concerning this Vacation Petition from the Area Plan <br /> Commission, Police Department, Fire Department, Sanitation, Department of Economic <br /> Development and the Department of Public Works. Economic Development stated that the vacation <br /> would prevent the properties on Dale Avenue from having access to the alley and building a fence <br /> does not seem to be a good reason to vacate. In addition, if this right-of-way is vacated, it be done <br /> so subject to any utility easements that are necessary. Therefore, Mr. Gilot made a motion that the <br /> Clerk send a letter to the petitioner addressing these concerns. Mr. Littrell seconded the motion <br /> which carried. <br /> FAVORABLE RECOMMENDATION -_ REQUEST TO VACATE VARIOUS STREETS - <br /> ANGELA BOULEVARD FROM NOTRE DAME TO EDDY STREET AND EDDY STREET <br /> FROM ANGELA BOULEVARD SOUTH TO PROPOSED EDISON ROAD <br /> Mr. Gilot indicated that The University of Notre Dame, Notre Dame, Indiana, has submitted a <br /> request to vacate the above referred to streets. Mr. Gilot advised that the Board is in receipt of <br /> favorable recommendations concerning this Vacation. Petition from the Area Plan Commission, <br /> Police Department, Fire Department, Sanitation, Department of Economic Development and the <br /> Department of Public Works. The Area Plan Commission stated that the vacation would hinder the <br /> growth or orderly development of the unit or neighborhood in which it is located,would make access <br /> to the lands of the aggrieved person by means of public way difficult or inconvenient, and would <br /> hinder the use of a public way by the neighborhood in which it is located. The Board of Public <br /> Works gave a favorable recommendation for this street vacation subject to a delayed effect based on <br /> resolution from the City Council and the Mayor concurrent with similar actions from St. Joseph <br /> County. In addition, if these rights-of-way are vacated, they be done so subject to any utility <br /> easements that are necessary. Therefore, Mr. Gilot made a motion that the Clerk send a letter to the <br /> petitioner addressing these concerns. Mr. Littrell seconded the motion which carried. <br /> APPROVAL OF RECOMMENDATION-TO CLOSE STREET-MEADE STREET BETWEEN <br /> NAPIER AND WESTERN - BIRTHDAY PARTY <br /> Mr. Gilot stated that favorable recommendations have been received by Traffic and Lighting,Police <br /> Department and the City Attorney's office, in reference to a request as submitted by Ms. Denise <br /> Smith, 3031 Meade, South Bend, Indiana,to conduct the above referred to block party on June 12, <br /> 2004, from 1:00 p.m. to 11:00 p.m. Upon a motion made by Mr. Gilot, seconded by Mr. Littrell and <br /> carried, the recommendation was approved. <br /> APPROVAL OF APPLICATION FOR SIDEWALK CAFE-FIDDLER'S HEARTH- 127 NORTH <br /> MAIN STREET <br /> Mr. Gilot advised that the Board is in receipt of favorable recommendations from the Division of <br /> Engineering, Police Department, Fire Department, and the Building Commissioner for a sidewalk <br /> cafe at Fiddler's Hearth, 127 North Main Street, South Bend, Indiana. Upon a motion made by Mr. <br /> Gilot, seconded by Mr. Littrell and carried, the recommendation was approved. <br />
