REGULAR MEETING APRIL 12 2004 unfit for the purpose for which it was intended and is no longer needed by the City of South Bend: ONE (1) HUNTER FAN MODEL NO. 30250 WHEREAS, Indiana Code 36-1-11-6(c) permits and establishes procedure for disposal of personal property which is unfit for the purpose for which it was intended and which is no longer needed by the City. NOW,THEREFORE,BE IT RESOLVED by the Board of Public Works of the City of South Bend that the items listed above are no longer needed by the City;are unfit for the purpose for which they were intended and have an estimated value of less than one thousand dollars ($1,000.00). BE IT FURTHER RESOLVED, that said equipment may be transferred or sold at public auction or private sale,without advertising. However,if the property is deemed worthless,such may be demolished or junked. ADOPTED this 12"" DAY OF APRIL, 2004. BOARD OF PUBLIC WORKS CITY OF SOUTH BEND, INDIANA s/Carl P. Jacob, Clerk ADOPT RESOLUTION NO. 12-2004 -ACCEPTING THE TRANSFER OF REAL PROPERTY FROM THE STATE OF INDIANA Upon a motion made by Mr.Littrell,seconded by Mr.Inks and carried,the following Resolution was adopted by the Board of Public Works: WHEREAS, the State of Indiana (herein after, the "State") is the owner of the certain real property situated in St. Joseph County, Indiana and being ore particularly described as Exhibit"A" hereto (hereinafter referred to as the "Real Property"; and WHEREAS,the City of South Bend,Indiana(herein after,the"City"),acting by and through the Board of Public Works,hereby expresses its desire to acquire Real Property from the State; and WHEREAS, the State is desirous of transferring the Real Property to the City; and WHEREAS, pursuant to I.C. 4-20.5-7-10, the State acting through Joseph E. Kernan, Governor, State of Indiana,and Charles R. Martindale,Indiana Department of Administration; has custody of and may maintain all State real property of Indiana; and WHEREAS,the State may exchange or transfer property with another governmental entity upon terms and conditions agreed upon by the two (2) entities;; and WHEREAS the State is willing to transfer the real property to the City upon payment of Sixteen Thousand Six Hundred Dollars ($16,600.00) per parcel and the City' agreement to assume responsibility for transfer fees and recording costs associated with the transfer and the City is agreeable to such terms and conditions. NOW,THEREFORE BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA THAT: I. The transfer of the Real Property situated in St. Joseph County, Indiana, and more particularly described as Exhibit"A", attached hereto,by the State of Indiana to the City of South Bend, Indiana, shall be, and hereby is accepted.
