;!D 9 8 REGULAR MEETING APRIL 12 2004 APPROVAL OF RECOMMENDATION TO ENCROACH ONTO PUBLIC RIGHT-OF-WAY - INSTALLATION OF AWNINGS - 129 NORTH MAIN STREET - MADISON OYSTER BAR Mr. Inks advised that the Board is in receipt of favorable recommendations from the Division of Engineering,Police Department,Building Commissioner and the Fire Department for the installation of awnings at the above referred to address. Upon a motion made by Mr. Littrell, seconded by Mr. Inks and carried, the recommendation was approved. APPROVAL OF RECOMMENDATION - TO CONDUCT "WALKAMERICA" - MARCH OF DIMES Mr. Inks stated that favorable recommendations have been received by Traffic and Lighting. Park Department,Police Department and the City Attorney's office,in reference to a request as submitted by Ms. Carol Hummer,March of Dimes,2012 Ironwood, South Bend,Indiana to conduct the above referred to event on April 24, 2004 on the designated route as submitted. Upon a motion made by Mr. Littrell, seconded by Mr. Inks and carried, the recommendation was approved. FAVORABLE RECOMMENDATION-PETITION TO VACATE AN ALLEY-MAIN STREET FROM IRELAND ROAD SOUTH TO HOOVER Mr. Inks indicated that Mr. Mike Hardy, Barnes&Thornburg, South Bend, Indiana,has submitted a request to vacate the above referred to rights-of-way. Mr. Gilot advised that the Board is in receipt of favorable recommendations concerning this Vacation Petition from the Area Plan Commission, Police Department, Fire Department, Sanitation, Department of Economic Development and the Department of Public Works. Engineering stated no objections to this becoming effective upon completion of the developer(s) gaining control of all properties and providing re-zoning and subdivision of properties, as «,-ell as approval of a development agreement. In addition, if these rights-of-way are vacated, they be done so subject to any utilit} easements that are necessary. Therefore, Mr. Littrell made a motion that the Cleric send a letter to the petitioner addressing these concerns. Mr. Inks seconded the motion which carried. FAVORABLE RECOMMENDATION - PETITION TO VACATE PROPERTY - TRIANGLE PIECE OF RIGHT-OF-WAY ON SOUTH SIDE OF CLEVELAND ROAD AND ADJACENT TO PROPERTY CURRENTLY OR FORMERLY OWNED BY USF HOLLAND Mr. Inks indicated that Mr. Steven Wonch, USF Holland,Inc., South Bend, Indiana, has submitted a request to vacate the above referred to portion of the right-of-way. Mr. Gilot advised that the Board is in receipt of favorable recommendations concerning this Vacation Petition from the Area Plan Commission, Police Department, Fire Department, Sanitation, Department of Economic Development and the Department of Public Works. Engineering stated that the vacation must be subj ect to an easement for sanitary sewer currently in place within the area to be vacated. Therefore, Mr. Littrell made a motion that the Clerk send a letter to the petitioner supporting the proposed vacation, subject to an easement as described. Mr. Inks seconded the motion which carried. APPROVAL OF SCRAP METAL DEALERS/JUNK DEALERS/RECYCLING OPERATIONS/TRANSFER STATIONS LICENSE APPLICATION Mr. Inks stated that the following application has been received: Michael's Tire Recycling 700 West Chippewa It was noted that favorable recommendations have been received by the Fire Department, Water Works and the Department of Code Enforcement. Upon a motion made by Mr.Littrell seconded by Mr. Inks and carried, the License Application was approved. ADOPT RESOLUTION NO. 10-2004-ACCEPTING THE TRANSFER OF CERTAIN PARCELS OF REAL ESTATE FROM THE NORTHERN INDIANA COMMUTER TRANSPORTATION DISTRICT Upon a motion made by Mr. Littrell,seconded by Mr.Inks and carried,the following Resolution was adopted by the Board of Public Works:
