;!D 9 8 <br /> REGULAR MEETING APRIL 12 2004 <br /> APPROVAL OF RECOMMENDATION TO ENCROACH ONTO PUBLIC RIGHT-OF-WAY - <br /> INSTALLATION OF AWNINGS - 129 NORTH MAIN STREET - MADISON OYSTER BAR <br /> Mr. Inks advised that the Board is in receipt of favorable recommendations from the Division of <br /> Engineering,Police Department,Building Commissioner and the Fire Department for the installation <br /> of awnings at the above referred to address. Upon a motion made by Mr. Littrell, seconded by Mr. <br /> Inks and carried, the recommendation was approved. <br /> APPROVAL OF RECOMMENDATION - TO CONDUCT "WALKAMERICA" - MARCH OF <br /> DIMES <br /> Mr. Inks stated that favorable recommendations have been received by Traffic and Lighting. Park <br /> Department,Police Department and the City Attorney's office,in reference to a request as submitted <br /> by Ms. Carol Hummer,March of Dimes,2012 Ironwood, South Bend,Indiana to conduct the above <br /> referred to event on April 24, 2004 on the designated route as submitted. Upon a motion made by <br /> Mr. Littrell, seconded by Mr. Inks and carried, the recommendation was approved. <br /> FAVORABLE RECOMMENDATION-PETITION TO VACATE AN ALLEY-MAIN STREET <br /> FROM IRELAND ROAD SOUTH TO HOOVER <br /> Mr. Inks indicated that Mr. Mike Hardy, Barnes&Thornburg, South Bend, Indiana,has submitted <br /> a request to vacate the above referred to rights-of-way. Mr. Gilot advised that the Board is in receipt <br /> of favorable recommendations concerning this Vacation Petition from the Area Plan Commission, <br /> Police Department, Fire Department, Sanitation, Department of Economic Development and the <br /> Department of Public Works. Engineering stated no objections to this becoming effective upon <br /> completion of the developer(s) gaining control of all properties and providing re-zoning and <br /> subdivision of properties, as «,-ell as approval of a development agreement. In addition, if these <br /> rights-of-way are vacated, they be done so subject to any utilit} easements that are necessary. <br /> Therefore, Mr. Littrell made a motion that the Cleric send a letter to the petitioner addressing these <br /> concerns. Mr. Inks seconded the motion which carried. <br /> FAVORABLE RECOMMENDATION - PETITION TO VACATE PROPERTY - TRIANGLE <br /> PIECE OF RIGHT-OF-WAY ON SOUTH SIDE OF CLEVELAND ROAD AND ADJACENT TO <br /> PROPERTY CURRENTLY OR FORMERLY OWNED BY USF HOLLAND <br /> Mr. Inks indicated that Mr. Steven Wonch, USF Holland,Inc., South Bend, Indiana, has submitted <br /> a request to vacate the above referred to portion of the right-of-way. Mr. Gilot advised that the <br /> Board is in receipt of favorable recommendations concerning this Vacation Petition from the Area <br /> Plan Commission, Police Department, Fire Department, Sanitation, Department of Economic <br /> Development and the Department of Public Works. Engineering stated that the vacation must be <br /> subj ect to an easement for sanitary sewer currently in place within the area to be vacated. Therefore, <br /> Mr. Littrell made a motion that the Clerk send a letter to the petitioner supporting the proposed <br /> vacation, subject to an easement as described. Mr. Inks seconded the motion which carried. <br /> APPROVAL OF SCRAP METAL DEALERS/JUNK DEALERS/RECYCLING <br /> OPERATIONS/TRANSFER STATIONS LICENSE APPLICATION <br /> Mr. Inks stated that the following application has been received: <br /> Michael's Tire Recycling <br /> 700 West Chippewa <br /> It was noted that favorable recommendations have been received by the Fire Department, Water <br /> Works and the Department of Code Enforcement. Upon a motion made by Mr.Littrell seconded by <br /> Mr. Inks and carried, the License Application was approved. <br /> ADOPT RESOLUTION NO. 10-2004-ACCEPTING THE TRANSFER OF CERTAIN PARCELS <br /> OF REAL ESTATE FROM THE NORTHERN INDIANA COMMUTER TRANSPORTATION <br /> DISTRICT <br /> Upon a motion made by Mr. Littrell,seconded by Mr.Inks and carried,the following Resolution was <br /> adopted by the Board of Public Works: <br />
