appointed as its agent with authority to communicate and negotiate concerning the acquisition or REGULAR MEETING JANUARY 26, 2004 disposition of real estate and may execute deeds and other documents customarily utilized at property closings. However, nothing in this Resolution shall prohibit the SBBPW itself from advertising, communicating about, negotiating or consuming the sale of real property. This resolution does not authorize the execution of deeds, unless by further Resolution of the SBBPW. NOW, THEREFORE, be it resolved by the SBBPW that this authorization shall continue until revoked by action of the SBBPW. Jacob, Clerk The undersigned, having examined the Resolution appointing her as limited agent of the Board of Public Works of South Bend,hereby accepts a limited pursuant to the terms and conditions contained above. s/Jennifer Hughes APPROVE CONSENT TO ANNEXATION AND WAIVER OF RIGHTS TO REMONSTRATE Mr. Gilot stated that the Board is in receipt of a Consent to Annexation and Waiver of Right to Remonstrate as submitted by Mr. Larry M. Lemke, Homeworks Investments, Inc., 54449 Maple Lane, South Bend, Indiana. The Consent indicates that in consideration for permission to tap into the public water system of the City, to provide water service to 54449 Maple Lane, Lot 165,Maple Lane Subdivision, South Bend,Indiana,(Key#02-2074-3440), Mr. Lemke waives and releases any and all right to remonstrate against or oppose any pending or future annexation of the property by the City of South Bend. Therefore, Mr. Gilot made a motion that the Consent be approved. Mr. Littrell seconded the motion which carried. AUTHORIZATION FOR ENTRY ONTO PUBLIC RIGHT OF WAY FOR DRILLING PURPOSES - ARK ENGINEERING Upon a motion made by Mr. Gilot, seconded by Mr. Littrell and carried,the Authorization for Entry Upon Public Property for Drilling Purposes, as submitted by Ark Engineering, was approved, to perform soil borings and drilling wells to monitor underwater soil pollution in the right of way area in the alley intersection ofLincolnway East and South Street south of the property at 702 Lincolnway East, APPROVE TRAFFIC CONTROL DEVICES Upon a motion made by Mr. Gilot,seconded by Mr. Littrell and carried,the following traffic control devices were approved: New Installation - No Perry Street - Western to City Engineer request Parking Sign Eddy- Both Sides New Installation - 748 Portage All requirements have been Handicapped Accessible met. Parking Space Signs Removal - Handicapped 1024 Notre Dame Avenue No longer needed. Accessible Parking Space Signs New Installation - No Maple & West Washington at City Engineer request.
