574 <br />_ AUGUST 221D, 1949 <br />REPORT OF THE COMMITTEE OF -THE WHOLE <br />To the Common Council of the City of South Bend: <br />August 22, 1949 <br />Your Committee of the Whole to whom was referred "An Ordinance supplementing Ordinance No. 3702 adopted <br />June 13, 1949, and commonly known as the Zoning Ordinance of the City of South Bende. <br />Respect report that they have examined the mutter and that in their opinion this ordinance should go to the <br />Council as favorable. <br />STANLEY C. KOHPAL, Chairman <br />Councilman Kemper made a motion that the report be accepted. Councilman Beetle seconded the motion. <br />Motion carried. <br />ORDINANCE NO. 3714 <br />AN ORDINANCE SUPPLEMENTING ORDINANCE N0. 3702 ADOPTED <br />JUNE 13, 1949, AND COMMONLY KNWN AS THE ZONING ORDINANCE <br />OF THE CITY OF SOUTH BEND. <br />The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays. <br />RESOLUTION. <br />VMREAS,.ordimneas and petitions for change of zoning are addressed to the Common Council and filed with <br />the..City Clerk, and <br />WHEREAS, these petitions are received by the Common Council and referred to the City Plan Commission on the <br />second and fourth Mondays of the month, and <br />WHEREAS, the regular meetings of the City Plan Commission are on the first Thursday of the month, <br />NON THEREFORE BE IT RESOLVED by the Common Council of the City of South Bend that the City Clerk be authorized <br />to receive such ordinances and petitions and after filing them transmit them to the Office of the City Plan <br />Commission in order to save time in getting such matters before the Council for their action. <br />(Signed) WALTER C. ERLER <br />Councilman Muszynski made a motion that all petitions filed for zoning come before the Council with the <br />recommendation that they be referred to the City Plan Commission. Councilman Niezgodski seconded the <br />motion. Motion carried by a roll call vote of 7 ayes - 1 nay (Eyler). <br />MOTIONS <br />Residents froth the East side appeared before the Council relative to the South Bend Avenue dump. Councilman <br />Kemper made a motion that thi-South Bend Avenue dump be closed for a month and the Board of Public Works <br />directed to solve the problem. Councilman Musty nski seconded the motion. Motion carried. <br />Mr. Andrysiak was unable to attend the meeting, therefore Mr. Baer reported on condition of the dump. <br />Residents from the infest side appeared before the Council relative to the conditions in the pavement of <br />Albert Avenue and near -by streets. Councilman Niezgodski made a motion that the conditions in the pavement <br />of Albert Avenue and near by streets be referred to the Board of Public Works to make a study of what can be <br />done about the'pavement and report back to the Council at its next regular meeting September*12th. Councilman <br />Mus Wnski made an amendment to the motion that a special committee be appointed, including the City Engineer <br />and Street Commissioner to join the Board of Public Works in their study as to what could be done. The chair <br />appointed Councilmen Muszynski, Glass and Korpal to work in conjunction with the Board of Public Works, the <br />City Engineer, and the Street Commissioner. Councilman Glass seconded the motion. Motion oarried. <br />There being no further business, Councilman Tellson made a motion to adjourn, which motion was seconded by <br />Councilman Niezgodski.
