559 <br />COMMITTEE OF THE WHOLE MEETING Ps 13TH, 1949 <br />Be•it remembered that the Common Council met in the Committee of the Whole meeting in the Council Chambers of <br />the City Hall, Monday evening, June 13th,,1949, at the hour of 8 :10 P.M. All members were present. Councilman <br />Korpal presided. <br />ORDINANCE NO. 3700 <br />An ordinance amending Ordinance No. 2331 commonly known as the zoning ordinance of the City of South Bend, <br />Indiana. <br />Councilman Erler moved that the said ordinance go to the Council as favorable. Councilman Beetle seconded <br />the motion. Motion carried. <br />ORDINANCE NO, 3701 <br />An ordinance appropriating from the General Street and Traffic Fund of the City of South Bend, Indiana, the <br />sum of Seventy -seven ($77,000.00) dollars to the following accounts of the 1949 budget: Street Department, <br />S- 251 -0, Repairs and Improvements to Streets, $57,000.009 also to Account S -711, Buildings, $20,000.00, and <br />declaring an extraordinary emergency. <br />Councilman Tellson moved that the said ordinance go to the Council as favorable. Councilman Glass seconded the <br />motion. Motion carried. <br />ORDINANCE NO. 3702 <br />An ordinance to regulate and restrict the location of trades, callings, industries, commercial enterprises, <br />and the location of buildings designed for specified uses; to regulate and limit the height of buildings <br />hereafter erected or altered; to regulate and determine the area of yards and other open spaces about buildings; <br />to regulate and determine the density of use of la,nctt areas, and for said purposes to divide the city into <br />districts and prescribe penalties for the violation of its provisions and to provide for its enforcement and <br />a Board' of Zoning Appeals. <br />Councilman Tellson reported to the Committee of the Whole that the new prolosed zoning ordinance was fully <br />discussed at meeting of all Counoilmen on May 27th, 1949, and no amendments or changes were recommended. <br />Councilman Kemper moved that the new proposed zoning ordinance be referred to the Council as unfavorable. <br />Councilman Beetle seconded the motion, and upon a roll call the motion was defeated by 2 ayes - 6 nays <br />(Erler, Korpal, Tellson, Niezgodski, Glass and Muszynski). Thereupon Councilman Niezgodski moved that the <br />new proposed zoning ordinance go to the Council as favorable from the Committee of the Whole. Said motion <br />was seconded by Councilman Glass and carried by a roll �JOO of 6 ayes - 2 nays (Nestle and Kemper). <br />There being no further business, the Committee of the Whole adjourned at 9:40:P *Mo <br />ATTEST: <br />CLERK <br />;HAIRMAN <br />
