475 <br />Be it remembered that the Common Council of the City-of South Bend,"Indiana, met in regular session in <br />the Council Chambers, City Hall, September 8th, 1947, at 7 :45 P.M. ,, with all members present except <br />Councilman Hull. President Brannan presided. The reading of the Minutes of the previous meeting was waived. <br />COPdMIMICATION <br />A Resolution adopted by the West Side Civic & Democratic Club, urging that provisions of the Ordinance <br />requiring dogs be restrained from May 1 to October 1st, be*stri "ctly enforced, was read. <br />Councilman Niezgodski made a motion that the communication be referred to the Board of Public Works and Safety. <br />'Councilman Mirocha seconded the motion. Motion carried. <br />PETITION <br />We, the undersigned on this Petition request that a street light be placed on the corners of N. Huey St. and <br />W. Smith St. This corner is totally dark and therefore proves itself extremely hazardous at night to <br />pedestrians. All the equipment that is necessary for this installation is the fixture as the pole and <br />wiring are located on this corner. <br />(94 Signers) <br />Councilman Heideman made a motion that the petition be referred to the Board of Public Works and Safety. <br />Councilman'Korpal seconded the 'motion. Motion carried. <br />PETITION <br />STATE OF' INDIANA ) <br />COUNTY OF ST. JOSEPH) <br />CITY OF 'SOUTH BEND ) <br />IN THE MATTER.OF THE PETITION ) <br />OF RLSIDENTS AND PROPERTY OWNERS) <br />ON EAST BROADWAY AM SURROUNDING) <br />AREA FOR ORDINANCE:RESTRICTING ) <br />HEIGHT OF GAS STORAGE TANKS ) <br />BEFORE THE COMTON COUNCIL IN AND FOR <br />THE CITY OF SOUTH BEND <br />The undersigned petitioners here represent to this honorable body: <br />1. That petitioners are each persons resident and most of them owners of residential property within the City of <br />South Bend, Indiana, and whose homes are more specifically located in the vicinity of the gas manufacturing <br />and storage plant of the Northern Indiana Publie'Service 'Company, and that they and each of them are directly <br />interested in the type of structures erected in the City of South Bend and particularly interested in <br />structures erected in the vicinity of their hems. <br />2. Petitioners aver they have information that the Northern Indiana Public Service Company has or will shortly <br />request the Building Commissioner in and for the City of South Bend to issue a permit allowing the building <br />of a structure in the height of approximately 372 Feet and width of approximately 150 feet, said structure to <br />be located just west of Miami Street and a few feet north of East Broadway; that the said building will be <br />an unsightly structure over twice the height of the Building and Loan Tower °Building of downtown South Bend and <br />will blight the surrounding residential district, causing a substantial decline in real estate values in said <br />area and that the collapse of such a tall and lean structure will be a constant un.combatable danger and <br />particularly so in view of the fact that said structure will be used for storage of inflammable gas and at a <br />heighttbeyond the present available water pressure of the fire fighting facilities of the City;, that <br />additionally said structure will exceed in height any structure within a one hundred mile radius of South bend <br />and will offer a constant threat to aircraft in flight at a time when the community is doing its utmost to <br />encourage air facilities here. <br />3. That to petitioners' knowledge there is no ordinance now in existence which governs height of this type of <br />constructure on this particular real property or anywhere else in South Bend and that there is a real need <br />for such an ordinance. <br />TEEREFORE, petitioners respectfully request that this honorable body cause the passing of an ordinance or <br />amendment to the present Building Code or 'Zoning Ordinance which will restrict or limit the height of any <br />structure to the height allowed for the construction of buildings as now provided by the present zoning <br />ordinance for the City of South fiend, Indiana. <br />(298 Signers) <br />Councilman Richardson made a motion that before Mr. Moomaw issues the building permit that he present plans <br />and speifications to the Council. Councilman Niezgodski seconded the motion.motion carried. <br />Councilman Richardson made a motion that the petition be recognized by the Council and placed on file for <br />further use if necessary. Councilman Niezgodski seconded the motion. Motion carried. <br />Councilman Richardson withrew his motion that before Mr. Moomaw issues the building permit that he present plans <br />and specifications to the Council. Councilman Niezgodski withdrew his second. <br />REPORT OF THE COL!MITTEE OF THE MHOLE <br />To The Common Council of the City of South Bend: <br />September 8th, 1947. <br />Your Committee of the Whole to whom was referred an Ordinance transferring monies from P -11, Salaries and <br />Wages, Police Department, to P -252 Repair of Equipment, Police Department, $4,000.00:; To P -331, Gasoline <br />Police Departmentm $3,600.00 ; "To P -333, Tires,Pnlice Department, $1,200.00; To P -3S, General Supplies, Police <br />Department, $400.00; To P -343, Laundry, Police Department, $80.00; To P -2:43, Photography and Blue Printing, <br />Police Department, $100.00; To P -36, Office Supplies, Police Department, $200.00, Declaring an emergency. <br />Respectfully report that they have examined the matter and that in their opinion this Ordinance shall be <br />reported to the Council as favorable. <br />WILLIAM J.
