357 <br />MAR CH 27 . 1944 <br />Be it remembered that the members of the Common Council of the City of South Bemd, Indiana, met in regular session <br />in the Council Chambers, City Hall, Monday, March 27, 1944, at 9:35 P.M. with all members pres -ent except Councilman' <br />McCarthy. President Niezgodski presided. The reading of the minutes of the previous meeting was waived. <br />REPORT OF THE COAP.ITTEE OF THE WHOLE March 27, 1944 <br />To the Common Council of the City of South Bend: <br />Your Committee of the Whole to whom was referred "An ordinance appropriating $810.00 from the General Fund of the <br />City of South Bend to Budgetary Account #3 -11 of said City, covering salaries for the Police Dept; declaring an <br />emergency. <br />Respectfully report that they have examined the matter and that in their opinion this ordinance shall go to the <br />Council favorably. <br />Wm. J. Richardson, Chairman <br />Councilman Brannan made a motion to accept the report. Councilman Korpal seconded the motion. Motion carried. <br />REPORT OF THE COTAITTEE OF THE WHOLE <br />To the Common Council of the City of South Bend: <br />March 27, 1944 <br />Your Committee of the Whole to whom was referred "An ordinance (as amended) defining restaurant, food, itinerant <br />restaurant, employee, utensils, Health Officer, and other terms; requiring permits for the operations of such es- <br />tablishments, prohibiting the sale of adulterated, unwholesome or misbranded food or drink; regulating the inspec- <br />tion, grading, regrading, and placarding of such establishments; providing for the enforcement of the ordinance; <br />fixing penalties. <br />Respectfully report that they have examined the matter and that in their opinion this ordinance shall be reported <br />to the Council favorably as amended. <br />Wm. J. Richardson, Chairman <br />Councilman Brannan made a motion to accept the report. Councilman Richardson seconded the motion. Motion carried. <br />ORDINANCE NO. 3481 <br />AN ORDINANCE APPROPRIATING $810.00 FRaD THE GENERAL FUITD OF THE CITY OF SOUTH <br />BEND TO BUDGETARY ACCOUNT NO. B -11 OF SAID CITY, COVERINu SI':L.LRIES FOR THE POLICE <br />DEPARD.ZENT: DECLARING AN EMERGENCY. <br />The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays - 1 absent (McCarthy). <br />ORDINANCE NO. 3482 (as amended) <br />AN ORDINANCE DEFINING RESTAURANT, FOOD, ITINERANT <br />HEALTH OFFICER, AND OTHER TEMdS: REQUIRING PERMITS <br />TABLISWT ENTS: PROHIBITING THE SALE OF ADULTERATED, <br />FOOD OR DRINK: REGIILATING.THE INSPECTTON, GRADING, <br />SUCH ESTABLIS1- D.1ENTS: PROVIDING FOR THE ENFORCRIIENT <br />PENALTIES. <br />RESTAURANT, EMPLOYEE, UTENSILS, <br />FOR THE OPERATION OF SUCH ES- <br />UNWHOLESOME, OR MISBRANDED <br />REGRADING AND PLACARDING OF <br />OF THIS ORDINANCE: FIXING <br />The ordinance was given second and third reading.and passed by a roll call vote of 5 ayes (Niezgodski, Brannan, <br />Korpal, Richardson and Mirocha) - 3 passes (Hull, Bishop and Heideman) - 1 absent (McCarthy). . <br />RESOLUTION <br />Be it resolved by the Common Council of the City of South Bend, that: <br />1. The proper officers of the City of South Bend, and of the City !later Works of said City, be <br />and the same are hereby authorized and directed to cause the amount of Twenty Thousand Dollars (120,000.00) to be <br />transferred from the City Water Works of said City to the General Fund of the City of South Bend, Indiana. <br />2. This resolution shall be in full force and effect from a nd of ter its adoption by the Common <br />Council, and its approval by the Mayor. <br />Councilman Brannan made a motion for the adoption of the Resolution.
