347 <br />ER 25. 1 <br />Be it remembered that the Common Council of the City of South Bend, Indiana, met in regular session in the Council <br />Chambers, City Hall, on Monday, October 25, 1943, at 8:07 P.M. with all members present except Councilman Richard- <br />son. President Brannan presided. The reading of the minutes of the previous meeting was deferred. <br />Councilman Heideman, chairman of the Miscellaneous Committee, stated that the Committee would make a report on the <br />jail inspection at the next meeting.- <br />The Committee of the Whole reported unfavorably on the ordinance requesting change of zoning for Lot X41 in Kaleyfs <br />Second Lincoln Highway Addition.The report of the City Plan Commission on the same ordinance was ordered tabled <br />for an indefinite period. <br />ORDINANCE (Lot #41 - Kaley's 2nd Lincoln Hwy.Addition - Lost) <br />AN ORDINANCE AMENDING AN ORDINANCE ENTITLED "AN ORDINANCE TO REGULATE AND RESTRICT THE LOCATION OF <br />TRADES, CALLINGS, INDUSTRIES, COMMERCIAL ENTERPRISES AND THE LOCATION OF BUILDINGS RESIGNED FOR <br />SPECIFIC USES; TO REGULATE AND LIMIT THE HEIGHT OF BUILDINGS HEREAFTER ERECTED OR ALTERED; TO <br />REGULATE AND DETERMINE THE AREA OF YARDS AND OTHER OPEN SPACES ABOUT BUILDINGS; TO REGULATE AND <br />DETERMINE THE DENSITY OF USE OF LAND AND LOT AREAS, AND FOR SAID PURPOSES TO DIVIDE THE CITY INTO <br />DISTRICTS AND PRESCRIBE IE NALTIES FOR THE VIOLATION OF ITS PROVISIONS, AND TO PROVIDE FOR ITS EN- <br />FORCEMENT AND A BOARD OF ZONING APPEALS" BY CHANGING THE ZONING CLASSIFICATION OF CERTAIN DESCRIBED <br />REAL ESTATE. <br />The ordinance was given third reading and lost by a roll call vote of 7 nays - 1 aye (McCarthy) - 1 absent. <br />ORDINANCE <br />AN ORIDTN_.NCE REIDUCING THE CURRECT OBLIGATIONS OF PRORRTIES (BUILDINGS AND FIXED EQUIPMENT ITEM) <br />BUDGETARY ITEMS PROVIIDE'D FOR IN THE 1943 BUDGET OF THE DEPARTMENT OF PUBLIC PARKS FOR THE CIVIL <br />CITY,; OF SOUTH BEND, INDIANA. <br />The ordinance was given first and second reading and set for public hearing on November 8th on motion of Councilman <br />Bishop, seconded by Councilman Korpal. <br />ORDINANCE <br />AN OR1DIANCE TRANSFERRING CERTAIN FUNDS FROM THE PARK MAINTENANCE FUND OF THE DEPARTMENT OF PUBLIC <br />PARKS OF THE CIVIL CITY OF SOUTH BEND, INDIANA FOR EMERGENCY PURPOSES. <br />The ordinance was given first and second reading and set for public hearing on November 8th upon motion of Council- <br />man Bishop, seconded by Councilman Heideman. <br />RESOLUTION <br />RESOLUTION AUTHORIZING MAYOR OF THE CITY OF SOUTH BEND TO SELL CERTAIN DESIGNATED REAL ESTATE <br />The resolution was adopted upon motion of Councilman Bishop, seconded by Councilman McCarthy. <br />A resolution from the Common Council of Hammond (read at previous meeting) was ordered held until the next meeting. <br />In,the meantime_thp City Attorney is to investigate the law and report to the Council on November 8th.-The motion <br />made by Councilman McCarthy, seconded by Councilman Hull. <br />Councilman Niezgodski, chairman of Streets & Alleys Committee, reported the committee is working with City Engineer <br />Williams in regard to railroad crossings. <br />Councilman Mirocha made a motion that the City Attorney draw up a resolution demanding that the railroad companies <br />fix all railroad crossings and walks immediately.
