Be it remembered that the Common Council of the City of South Bend, Indiana, met in regular session on August 9,
<br />1943, in the Council Chambers, City Hall, at 7:30 P.M. with all members present. President Brannan presided.-The
<br />reading of the minutes of the previous meeting was waived.
<br />A communication from Mayor Jesse I. Pavey, relative to the proposed budget, was read and on motion of Councilman
<br />Niezgodski, seconded by Councilman Richardson, was ordered placed on file.
<br />Councilman Richardson made a motion that the Mayor shall fix a date for a meeting of the Finance Committee, motion
<br />seconded by Councilman Niezgodski. Motion carried. (Said meeting set for Friday, August 13th, 1943, at 7:30 P.M.)
<br />A communication from the South Bend Civic Planning Association, in the form of a resolution, requesting the establis
<br />ment of definite boundaries of all streets and alleys in the downtown district of South Bend, was referred to the
<br />Streets & Alleys Committee, upon motion of Councilman Richardson, seconded by Councilman Korpal.
<br />Several communications of Clyde E. Williams, City Engineer, and G. A. Farabaugh, Attorney for NYCRR, were ordered
<br />placed on file.
<br />A report from Ernest H. Miller, City Traffic Engineer, regarding "no parking "' restrictions on Mishawaka Avenue at
<br />23rd Street, was ordered placed on file.
<br />A report from the Board of Public Works and Safety regarding the installation of street lights- at the alley inter-
<br />sections of Michigan Street and St. Joseph Street and Western and Monroe Streets, was ordered placed on file.
<br />Councilman McCarthy made a motion that the petitioners be notified and given information contained in report.Motion
<br />seconded by Councilman Heideman. Motion carried.
<br />The report of the City Controller for the month of June, 1943, was ordered placed on file upon motion of Councilman
<br />Richard -son, seconded by Councilman Bishop.
<br />The report of the City Controller for the month of July, 1943, was ordered placed on file upon motion of Councilman
<br />Bishop, seconded by Councilman Richardson.

<br />INDIANA, TO CERTAIN SPECIFIED ACCOUNTS, APPROPRIATING SAID AMOUNTS TO EACH SUCH ACCOUNT; DECLARING

<br />The- ordinance was given first reading. Councilman Bishop made a motion that the ordinance be referred to the Finance
<br />Committee for consideration at meeting of August 13, 1943. Councilman Korpal seconded the motion. Motion carried.

<br />AN ORDINANCE AMENDING AN ORDINANCE ENTITLED "AN ORDINANCE TO REGULATE AND RESTRICT THE LOCATION
<br />OF TRADES, CALLINGS, INDUSTRIES, C9TMERCI_AL ENTERPRISES AND THE LOCATION OF BUILDINGS 'DESIGNED
<br />FOR SPECIFIC USES; TO REGULATE AND LIMIT THE HEIGHT OF BUILDINGS HEREAFTER ERECTED OR ALTERED;
<br />TO REGULATE ANT- DETERr:IINE THE AREA OF YARDSAND OTHER OPEN SPACES ABOUT BUILDINGS; TO REGULATE
<br />AND DETERMINE THE DENSITY OF USE OF LAND AND LOT AREAS, AND FOR SAID PURPOSES TO DIVIDE THE
<br />CITY INTO DISTRICTS AND PRESCRIBE PENALTIES FOR THE VIOLATION OF ITS PROVISIONS, AND TO PROVIDE

<br />The ordinance was given first reading and referred to the City Plan Commission on motion of Councilman McCarthy,
<br />seconded by Councilman Bishop.
<br />RESOLUTION
<br />AUTHORIZING THE MAYOR OF THE CITY OF SOUTH BEND TO SELL CERTAIN IDESIGNATEID REAL ESTATE.
<br />WHEREAS, the City of South Bend is the owner of the following described real estate in the County of St. Joseph,
<br />State of Indiana, to -wit:
<br />The east ( 2) half of the north (RO) half of the south lest (SV4) quarter of the northwest (NW4)
<br />quarter of Section 34, Township 38 north, Range 2 east, containing ten (10) acres more or less.
<br />WHEREAS, continued ownership of the above described property is not necessary essential for conducting the business
<br />of the city, and
<br />WHERE -4S, it is deemed advisable that the said land be sold,
<br />N011V, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana that:
<br />Section 1. The Mayor of the said city shall be, and he is, hereby authorized to sell and convey the above described
<br />premises.
<br />Section 2. The Mayor shall conduct such sale and make such conveyance in conformity with the requirements of Clause
<br />50 of Section 48 -1407, Burns Indiana Statutes, 1933.
<br />Councilman Bishop made a motion to adopt the Resolution. Councilman Richardson seconded the motion. Motion carried
<br />RESOLUTION
<br />Be it resolved that the South Bend City :Council do hereby extend to the family of Sid Thornton its sympathy and con-
<br />dolence in his death.
<br />The City Council and South Bend recognizes in the passing of Mr. Thornton the loss of a very valuable citizen who
<br />has served the City of South Bend, both as a City Councilman for several terms and as a private citizen.
<br />It is further resolved that this resolution, properly signed by the President of the City,Council, be forwarded to
<br />the family. of Mr. Thornton.
<br />Councilman Richardson made a motion to adopt the Resolution. Councilman Heideman seconded the motion. Motion Carr
<br />Councilman Bishop:im,de a motion,that` `the Council meet-t6 consider report of Finance Committee and to consider the
<br />budget ordinances on Monday, August 16, 1943. Councilman McCarthy seconded the motion. Motion carried.
