:309 <br />Be it remembered that the Common Council of the City of South Bend met in regular session in the Council Chambers, <br />City Hall, on Monday, May 11, 1942, at 7 :52 P.M. with all members present. At the request of President Pulaski, <br />Vice- president Hull presided. The reading of the minutes of the previous meeting was waived. <br />IREPOBT OF THE COMMITTEE OF THE WHOLE <br />ITo the Common Council of the City of South Bend: <br />May 11, 1942 <br />Your Committee of the Whole to whom was referred "An ordinance requiring New York Central Railroad Company to instal] <br />and maintain the latest improved automatic flashlight signals and automatic shortarm gates at Olive and Meade Street: <br />cm ssings with its right -of -way in the City of South Bend, Indiana. <br />Respectfully report that they have examined the matter and that in their opinion this ordinance shall go to the <br />Council favorably. <br />LEO. P.4. JORDAN, Chairman <br />Councilman Bishop made a motion to accept the report. Councilman Niezgodski seconded the motion. Motion carried. <br />ORDINANCE NO. 3419 <br />AN ORDINANCE REQUIRING NEW YORK CENTRAL RAILROAD COMPANY TO INSTALL AND MAIFTAIN THE <br />LATEST IMPROVED AUTOMATIC FLASHLIGHT SIGNALS AND AITTOMATIC SHORTARM GATES AT OLIVE <br />AND MEADE STREETS CROSSINGS WITH ITS RIGHT -OF -WAY IN THE CITY OF SOUTH BEND, INDIANA. <br />IThe ordinance was given third reading and passed by a roll call vote of 9 ayes - 0 nays. <br />I RESOLUT Iff <br />RESOLUTION AUTHORIZING THE ALIENATION, SALE AND CONVEYANCE OF REAL PROPERTY. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, That: <br />Section 1: That the Mayor of the City of South Bend be, and is hereby authorized to alienate, sell and convey the <br />following described real estate located in the City of South Bend, St. Joseph County, State of Indiana, to -wit: <br />Beginning on the North Line of Lincoln Way East at a point where the West line of Lot <br />26 South Bend Mfg. Cogs Addition produced southerly intersects the Northerly line of <br />said Lincoln Way East, as now located, which point is 13:05 feet from the original South <br />West corner of said Lot 26, thence North 60 degrees West along the present Northerly line <br />of said Lincoln Way East a distance of 64.86 feet; thence North 30 degrees East, at right <br />angles to the northerly line of said Lincoln Way East a distance of 95..37 feet to the <br />intersection of the Westerly line of Lot 26 said South Bend Mfg. Cogs Addition; thence <br />South 18 degrees West along the Westerly line of said Lot 26 a distance of 34.54 feet to <br />angle in said Lot line; thence South 30 degrees West along the Westerly line of said Lot <br />26 a distance of 81.87 feet to the place of beginning. All in the City of South Bend, <br />At. Joseph County, Indiana. <br />Section 2: Said property, however, shall be appraised by three disinterested freeholders of the City of South Bend <br />appointed by the.Ju4ge of the Circuit Court of St. Joseph County, and no sale or conveyance of the above described <br />property shall be made for a less sum than such appraisement. <br />Dated: This day of May, 1942. <br />Councilman Richardson made a motion for the adoption of-the Resolution.
