Be it remembered that the Common Council of the City of South Bend, Indiana, met in regular session in the Council <br />Chambers, City Hall, Monday, March 9, 1942, at 7:40 P.M. with all members present except President Pulaski and Coun- <br />cilman Brannan. Vice - president Hull presided. The reading of the minutes of the previous meeting was waived. <br />A communication from the City Water Yorks, signed by Giles L. Cain, Supt., regarding certain specific changes in <br />specification in a contract for two gravel wall type wells, said contract made with the Layne - Northern Company, <br />was read by the Clerk. Councilman Bishop made a motion that the communication be accepted. Councilman McCarthy <br />seconded the motion. Motion carried. <br />PETITION <br />TO THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA. <br />The undersigned respectfully petitions the Common Council of the city of South Bend, Indiana and for cause of peti- <br />tion alleges; <br />That he is the owner of Lot 41 as shown on the Recorded Plat of Kaley's Second Addition to the City of South Bend: <br />That said lot is bounded on the North by Humbolt Street, on the east by Elliott Street, on the South by Lincolnway <br />West and on the West by GoodlandAve; <br />That said lot is now zoned as B Residence; <br />That said lot has no value as a place to build a residence; <br />That said lot in order to be made of any value to the owners of said lot should be changed from B Residence to C <br />Commercial. <br />Wherefore your petitioner prays the Common Council of the city of South Bend to pass an ordinance classifying the <br />above lot as C Commercial. <br />WILLARD R. Motion carried. <br />PETITION <br />TO THE HONORABLE BOARD OF PUBLIC WORKS & SAFETY (Form) <br />(Gentlemen: <br />We the undersigned property owners, petition your honorable body to improve Brookfield street fr an Lincolnway West <br />to Werwinski street by the installation of a street light, Corner Brookfield and Rapel Sts. <br />(22 Signers) <br />The petition was presented to the Council by Councilman Niezgodski. Councilman Ri chardson made a motion to present <br />the petition to the Board of Works. Councilman Niezgodski seconded the motion. Motion carried. <br />A report from the Board of Public Works & Safety, signed by James P. Conboy, relative to bus shelters was ordered <br />placed on file on motion of Councilman Heideman, seconded by Councilman Bishop. Motion carried. <br />A'.report from the-City Plan Commission, dated March 9, 1942, relative to a Petition of Portage Realty Co., was order - <br />ed placed on file on motion of Councilman Bishop, seconded by Councilman McCarthy. Councilman McCarthy seconded the motion. <br />Motion carried. <br />ORDINANCE NO. 3412 <br />AN ORDINANCE AUTHORIZING THE APPRAISAL AND SALE OF CERTAIN BARRETT LAW <br />BONDS AND COUPONS AND THE INTEREST OF THE CITY WITH RESPECT THERETO ISSUED <br />BY SAID CITY IN CONNECTION WITH IMPROVEMENT RESOLUTION NO. 1702. <br />The,ordinance was given first and second reading. Upon the suggestion of City Attorney Levy, Councilman Bishop <br />made a motion for suspension of the rules. Councilman Jordan. seconded the motion. Motion carried.by a roll call <br />vote of 7 ayes - 0 nays - 2 absent(Pulaski and Brannan) The ordinance was then given third reading and passed by a <br />roll call vote of 7 ayes - 0 nays - 2 absent (Pulaski and Brannan) <br />ORDINANCE NO. 3413 <br />AN ORDINANCE AUTHORIZING AND APPROVING THE EXECUTION OF AN INDENTURE OF EASEMENT <br />BETWEEN THE CITY OF SOUTH BEND, INDIANA AND THE AETNA LIFE INSURANCE COMPANY. <br />The ordinance was given first and second reading and upon the suggestion of City Attorney Levy Councilman Heideman <br />made a motion for the suspension of rules. Councilman Niezgodski seconded the motion. Motion carried by a roll <br />call vote of 7 ayes - 0 nays - 2 absent (Pulaski and Brannan). The ordinance was given third reading and passed <br />by a roll call vote of 7 ayes - 0 nays - 2 absent (Pulaski and Brannan) <br />By unanimous agreement, a five - minute recess was called at 8:,00 P.M. The meeting reconvened at 8:.08 P.M. <br />(ORDINANCE <br />AN ORDINkNTCE FIXING THE SALARIES OF CERTAIN CITY OFFICIALS AND EMPLOYEES OF THE <br />CITY OF SOUTH BETUD,INDIANA EFFECTIVE JANUARY 1, 1943 AND REPEALING ALL ORDINANCES <br />AND PARTS OF ORDINANCES IN CONFLICT THEREWITH. <br />The Clerk read a letter from Mayor J. I. Pavey which accompanied the above ordinance. The ordinance was given <br />first and second reading after Councilman McCarthy had made a statement to.the effect that although he had signed <br />the ordinance as presented to the Clerk, it did not mean that approved or disapproved the ordinance but had done so <br />simply to introduce the ordinance to the Council. Councilman Richardson made a motion to refer the ordinance to <br />4 <br />
