Motion carried by vote of 7 ayes - 2 nays (McCarthy <br />and Niezgodski) <br />REPORT OF CLAIMS COM1 IITTEE <br />TO THE MEMBERS OF THE COMMON COUNCIL: <br />March 16, 1940 <br />In accordance with instructions given the Claims Committee at the regular meeting of the Common Council of the Ci <br />of South Bend on March 11, your Claims Committee has investigated the alleged charge of the Indiana & Michigan <br />Electric Company against the City of South Bend, for an unpaid bill they claim due for electric power and light <br />furnished in the years of 1932, 1933 and 1934. <br />We find that the balance of appropriation brought forward from 1933, as authorized by the State Board of Accounts, <br />was X93,770.56, and the regular appropriation for the year 1934 was $95,000.00, making a total of $188,770.56. The <br />amount of appropriation and the balance was entirely paid out on December 20, 1934, and the amount claimed was <br />beyond the monies appropriated for that particular use. <br />Your Committee was reliably informed that under existing laws the Controller has no legal authority to pay out the <br />monies claimed unless authorized to do so by court mandate. <br />It is the opinion of your Committee that while a certain measure of responsibility should be placed upon the Board <br />of Public Works in office at the time the appropriation was exhausted, that a larger portion of the responsibility <br />rests with the Indiana & Michigan Electric Company, who knowingly furnished more power and light than what was <br />appropriated for in the budget for that year, and that the City Attorney be instructed to use every effort within <br />his legal control to procure a verdict in favor of the city, as, in our judgment, this is not a just claim. <br />WALTER A. Bend: <br />Your Committee of the Whole to whom was referred a Proposed Milk Ordinance for the City of _South Bend, Indiana, <br />"An ordinance defining "milk's and certain "milk products ", "milk producer ", "pasteurization', etc. prohibiting the <br />sale of adulterated and misbranded milk and milk products, requiring permits.for the sale of milk and milk <br />products, regulating the inspection of dairy farms and milk plants, the.examination, grading, labeling, placard <br />ing, pasteurization, regrading, distribution, and sale of milk and milk products, providing for the publishing <br />of milk grades, the construction of future dairies and milk plants, providing for the licensing of dairies - retail <br />and wholesale distributors, the enforcement of this ordinance, and the fixing of penalties." <br />Respectfully report that they have examined the matter and that in their opinion this ordinance shall be held in <br />the Committee of the Whole for further consideration. <br />LEO M.
