A RESOLUTION CONFIRMING THE ADOPTION OF A DECLARATORY RESOLUTION DESIGNATING CERTAIN AREAS WITHIN THE CITY OF SOUTH BEND, INDIANA, COMMONLY KNOWN AS 1047 Lincoln Way East TO BE AN ECONOMIC REVITALIZATION AREA FOR PURPOSES OF A FIVE (5) YEAR PERSONAL PROPERTY TAX ABATEMENT FOR Crooked Ewe, Inc. WHEREAS, the Common Council of the City of South Bend, Indiana, has adopted a Declaratory Resolution designating certain areas within the City as Economic Revitalization Areas for the purpose of tax abatement consideration; and WHEREAS, a Declaratory Resolution designated the area commonly known as 1047 Lincoln Way East, South Bend, Indiana, and which is more particularly described as follows: Parcel 1: Lots G Two (G -2), F Two (F -2) and E Two (E -2) as shown on the recorded Plat of Wenger and Krieghbaum's Vistula Avenue Addition, more fully described as beginning on the West edge of the St. Joseph River on the line between lots "G -2" and "H -2" as shown on the recorded Plat of Wenger and Krieghbaum's Vistula Avenue Addition: thence Southwest on the line between said "Lots "G -2" and "H- 2" to Lincoln Way East; thence Northwest on the Easterly line of Lincoln Way East 136.7 feet; thence Northeast parallel to the line between said Lots "G -2" and "H -2" 30 feet; thence Northwest parallel to Lincoln Way East 50 feet; thence Northeast parallel to the line between said Lots "G -2" and "H -2 ", to the St. Joseph River, thence Southeast along said river to the place of beginning. Parcel II: Lots H Two (H -2) and I Two (1 -2) as shown on the recorded Plat of Wenger and Krieghbaum's Vistula Avenue Addition to the City of South Bend recorded November 17, 1908 in Plat Book 9, page 100 in the Office of the Recorder of Saint Joseph County, Indiana. and which has Tax Key Numbers 018 - 7017 -0684; 018 - 7017 -0682; and 018- 7017 -0680 presently, as an Economic Revitalization Area; and WHEREAS, notice of the adoption of a Declaratory Resolution and the public hearing before the Council has been published pursuant to Indiana Code 6 -1.1- 12.1 -2.5; and WHEREAS, the Council held a public hearing for the purposes of hearing all remonstrances and objections from interested persons; and WHEREAS, the Council has determined that the qualifications for an economic revitalization area have been met. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. The Common Council hereby confirms its Declaratory Resolution designating the area described herein as an Economic Revitalization Area for the purposes of tax abatement. Such designation is for Personal Property tax abatement only and is limited to two (2) calendar years from the date of adoption of the Declaratory Resolution by the Common Council, SECTION II. The Common Council hereby determines that the property owner is qualified for and is granted Personal Property tax deduction for a period of five (5) years, and further determines that the petition complies with Chapter 2, Article 6, of the Municipal Code of the City of South Bend and Indiana Code 6- 1.1 -12 et seq. See the attachment required pursuant to Indiana Code 6- 1.1- 12.1 -17. SECTION III. This Resolution shall be in full force and effect from and after its adoption by the Common Council and approved by the Mayor. We intend to open a Brewpub where we can self- distribute our manufactured beer as well as establish a regional footprint in distributing within 5 years of opening We will be obtaining thirteen (13) vessels (ranging from 310 gallons to 400 gallons) and using various means for liquid transfer pumps. A small computers stem will also be installed for brewing software which will allow us to closely monitor the product. In addition we will install twenty (20) solar panels to be placed on the roof to aid in water heating. The equipment will define our business as a Brewery/Pub. 2. The project will: (a) create fourteen permanent, full -time and five permanent, part- time jobs within the first year, representing a new annual payroll of $ 485,320.00 / ind tips and (b) maintain n/a existing, permanent, full -time and n/a existing, permanent, part-time jobs representing an annual payroll of $ n/a for existing employees. 3. Provide current wage information for existing employees including: base rate, cost - of- living allowances, hazardous -duty pay, incentive pay including commissions and production bonuses, on -call pay and tips (please show average hourly rate or range). Do Not Include: back pay, jury duty pay, overtime pay, severance pay, shift differentials, non - production bonuses, and tuition reimbursements. Other anticipated public financing for the project including, if any, industrial revenue - bonding to be sought or already authorized, assistance through the United States Department of Housing and Urban Development funds from the City of South Bend, Small Business Administration Sections 503 and 504 financing through the Business Development Corporation of South Bend, Mishawaka, and St. Joseph County, Indiana, Industrial Revolving Fund; or other public financial assistance, including but not limited to public works improvements. Small financing ($25,000 or less) will be obtained in the form of a Small Business Administration Section 504 Loan to aid in the purchasing and installing of the solar panel system.
