June 6, 3932. <br />on June 62' 1932.; <br />on June 6, 1932. <br />on June 6, 1932.' <br />on June 62 1932.' <br />Dated this 6th day of June, 1932: <br />LeRoy Poure <br />Member of South Bend Piblice Force:' <br />The Report of the Call was accepted by the Council:"` <br />MAYORIS VETO MESSAGE. <br />June 1, 1932.' <br />TO THE HONORABLE MEMBERS OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA. <br />Gentlemen: -- I have carefully examined Ordinance Mo.'2983 which was enacted by your Honorab <br />Body. under suspension of the rules, at your regular meeting May 20th, 1932, and have vetoed <br />the same for the following reasons: <br />I can not concur in ypur analysis contained in the introduction or the first <br />paragraph of the Ordinance in which it statesw in substance, that no safeguards or precautio <br />whatsoever have been thrown about the Department:' All actions of the Purchasing Clerk relat <br />to his duties are under the direct supervision of the Department issuing a requisition for <br />purchases strictly in accordance with the Statute regulating all purchases. Payment is not_ <br />made by the Clerk and his sole duty is to procure competitive bids so that the various <br />departments through which he is working, may obtain that best merchandise or supplies at the <br />lowest possible cost: <br />I am advised that Section Two of said Ordinance is unconstitutional as it is <br />in direct violation of the Statute governing purchases which, in - substance, provides that th <br />several departments shall make all purchases and thereby allows the various departments <br />to employ clerks to carry on this work.' Before this position was created legal opinion was <br />obtained from the City Attorney which has been submitted in writing ki d subsequently approve <br />by the State Board of Accounts. I am attaching the opinions of the ty Attorney and State <br />Board of Accounts together with other communications in this matter, rto this reply and <br />request that they be returned to the City Controller for his files. <br />Reports in myv possession, whfch are available at any time for your perusal$ <br />demonstrate clearly, that the Purchasing Clerk has effected a saving to the City very much in <br />of the salary paid:' <br />I do not believe that your Honorable Body is in doubt as. to my intention to <br />effect a substantial saving in money to the City where ever possible.! I have gladly concurr <br />in your opinions:-set forth in the resolution affecting salaries of officials and assistants <br />throughout the various departzments but I do not believe my duty stops there.` For that real <br />I enoourpagd.dthe appointment of a Purchasing Clerk and have followed with great interest this <br />one phase of an economy program .' This makes for real economy and compares favorable. with <br />similar action taken in the organization and maintenance of any business enterprise,. <br />In cons `lusion : I must believe that, for some reason your Honorable Committee <br />and Body were not thoroughly apprised of the purposez of the Clerk's duties and all other <br />attending facts, before the passage of this Ordinance, and that you.were not thoroughly <br />aware of the unconstitutionality of the Section mentioned in,the foregoing. It is my sincer <br />hope that *ou reconsider this action so that a most essential provision of the City's <br />economy program may not be nullified.' <br />Respectfully �P submitted . R.'
