APPENDIX "B" <br />INFORMATION AND SERVICES TO BE FURNISHED BY OWNER <br />A. OWNER shall do the following in a timely manner so as not to delay the services <br />of the ENGINEER: <br />Designate in writing a person to act as OWNER's representative with <br />respect to the services to be rendered under this Agreement. Such <br />person shall have complete authority to transmit instructions, receive <br />information, interpret and define OWNER's policies and decisions with <br />respect to the ENGINEER's services for the Project. <br />2. Provide all criteria and full information as to OWNER's requirements for <br />the Project, including design objectives and constraints, space, capacity <br />and performance requirements, flexibility and expandability, and any <br />budgetary limitations. <br />3. Furnish to ENGINEER, as required for performance of ENGINEER's Basic <br />Services (except to the extent provided otherwise in Appendix "A ") the <br />following: <br />a. Data (plans, title abstracting and encumbrance reports) prepared by <br />OWNER and /or others or services of others and appropriate <br />professional interpretations of such for materials necessary during the <br />negotiations process. <br />4. Arrange for access to and make all provisions for ENGINEER and /or <br />Subcontractors to enter upon public and private property as required to <br />perform services under this Agreement. <br />5. Examine all drawings and other documents presented by ENGINEER, <br />obtain advice of attorney, insurance counselor and other consultants as <br />OWNER deems appropriate for such examination and render in writing <br />decisions pertaining thereto within a reasonable time so as not to delay <br />the services of ENGINEER. <br />6. Furnish all legal services as may be required for the development of the <br />project including review and approval of conveyance documents by City <br />Attorney, legal counsel and services for condemnation proceedings, if <br />needed. <br />7. Provide written approval of completed work phases as described in <br />Appendix "A" of the Agreement. Accomplish reviews and provide written <br />approvals in a timely manner. <br />8. Furnish, or direct ENGINEER to provide, Additional Services as stipulated <br />in Appendix "E" of this Agreement or other services as required. <br />Bowen Street Right of Way Engineering, Staking & Acquisition Services APPENDIX "B" <br />August 2013 <br />Page 1 of 2 <br />
