The Special Use is located in the LI Light Industrial District. The proposed gymnastic <br />studio is a supervised activity that is conducted inside the existing building with <br />sufficient off street parking. <br />(2) The proposed use will not injure or adversely affect the use of the adjacent area or <br />property values therein. <br />The petitioner is proposing to use an existing building and parking lot. The gymnastics <br />studio will not adversely affect the other uses permitted in the Light Industrial District. <br />(3) The proposed use will be consistent with the character of the district in which it is <br />located and the land uses authorized therein. <br />The proposed use is consistent with the character of the surrounding district. The <br />gymnastics studio will be contained within an existing building, which is adaptable to a <br />variety of uses. <br />(4) The proposed use is compatible with the recommendations of the Comprehensive Plan. <br />One of the objectives of The City of South Bend, Indiana Comprehensive Plan <br />(November 2006) is to increase opportunities for youth to participate in artistic and <br />cultural activities. The special exception for the gymnastics studio is consistent with this <br />objective. <br />The staff recommends approval of the variance request for parking. <br />14. Petition of Jeffery and Patricia Hoshaw. <br />If the Zoning Administrator determines this use meets the criteria for Home Occupation in <br />connection with which no mechanical or electrical equipment is used except such as is <br />permissible for purely domestic and household purposes, the Staff recommends that the <br />Special Use be sent to the County Council with a favorable recommendation. <br />(1) The proposed use will not be injurious to the public health, safety, comfort, community <br />moral standards, convenience or general welfare. <br />The portion of use related to gunsmith /gun shop is only a portion of the larger activity <br />and will be contained indoors. Petitioner states that all vapor is vented through a high <br />performance reclaim system. <br />(2) The proposed use will not injure or adversely affect the use of the adjacent area or <br />property values therein. <br />The petitioner states the items are small in size and would not be noticed by adjacent <br />neighbors. Provided all work is conducted inside the dwelling or accessory structure, <br />there should not be an impact on the adjacent area. <br />(3) The proposed use will be consistent with the character of the district in which it is <br />located and the land uses authorized therein. <br />The proposed use will be contained to the garage /workshop so it as to not impact the <br />character of the area. <br />(4) The proposed use is compatible with the recommendations of the Comprehensive Plan. <br />The Comprehensive Plan for South Bend and St. Joseph County, Indiana (April 2002) <br />makes no mention on specific uses and special uses. <br />Sincerely, <br />n ..
