Jefferson Blvd. <br />South Bend, Indiana 46601 <br />Dear Council Members: <br />SOUTH BEND, INDIANA 46601 <br />May 5, 1978 <br />219/284 -9241 <br />The attached Ordinance is submitted for your favorable action. <br />On December 7, 1977, this Council passed three (3) ordinances <br />which had the combined effect of amending the South Bend "Municipal <br />Electric Code, Building Ordinance and Fire Code. These ordinances <br />were quite lengthly and involved exhaustive revisions of these <br />sections. <br />In accordance with Section 32 of the Indiana Code, Title 22, <br />Article 11, Chapter 1, these ordinances were submitted to the Indiana <br />Administrative Building Council for approval. This approval, to- <br />gether. with your action in passing these ordinances, is needed before <br />enforcement can begin. <br />The Administrative Building Council has approved all of the pro- <br />visions of two of these ordinances in their entirety. The Administra- <br />tive Building Council approved all of the sections in the new Fire <br />Code except two. The ordinances passed by the Council contained a <br />requirement that all buildings exceeding 1500 square feet and open to <br />the public be equipped with automatic sprinkling devices. The Fire <br />Code also contained a ban on the use of carpeting on the ceilings or <br />at a height of more than four inches from the floor in any commercial <br />business. The Administrative Building Council failed to approve these <br />two provisions. <br />Since these two provisions cannot be enforced without approval of <br />the Administrative Building Council they should not be printed in the <br />South Bend municipal Code. The attached ordinance, if passed, will <br />eliminate these unenforceable provisions. <br />Your favorable reaction on this will facilitate the publishing of <br />the affected portions of the South Bend Municipal Code sections and <br />will at the same time maintain its integrity. <br />Respectfully submitted, <br />Steven L.
