ORDINANCE NO. & cep q --? <br />AN ORDINANCE AMENDING CHAPTER 15, ARTICLE 1, <br />COMMONLY KNOWN AS THE RAILROAD TRAINS ORDINANCE <br />STATEMENT OF PURPOSE AND INTENT <br />The Common Council of the City of South Bend recognizes that <br />the sounding,of train whistles at certain crossings within the City <br />limits creates an unreasonable disturbance to the peace and repose <br />of citizens residing in proximity to these crossings. The purpose <br />and intent of this Ordinance is to exercise the authority of the <br />City under State law, subject to the approval of the Public Service <br />Commission of Indiana, by regulating the sounding of train whistles <br />within the limits of the City of South Bend. <br />NOW, THEREFORE, BE IT ORDAINED by the Common Council of the <br />City of South Bend, Indiana, as follows: <br />SECTION I. Chapter 15, Article 1, Section 15 -3 of the <br />Municipal Code of the City of South Bend, Indiana is hereby amended <br />by adding a new Section 15 -3.1 as follows: <br />No person operating or controlling any locomotive engine <br />shall sound the whistle or horn thereof, or allow it to <br />be sounded upon approaching or crossing the Penn Central <br />Railroad Company crossings at the following streets in <br />South Bend, Indiana: Vernon Street, Leer Street, <br />Robinson Street, Twyckenham Drive, Caroline Street, <br />Ironwood Drive. <br />SECTION II.
