ORDINANCE NO. 4121L.72 <br />r72 <br />AN ORDINANCE REPEALING ORDINANCE NO. 6330 -78 AND <br />AMENDING AND SUPPLEMENTING CHAPTER 6 OF THE <br />MUNICIPAL CODE OF SOUTH BEND, INDIANA, GENERALLY <br />KNOWN AS THE BUILDING CODE OF THE CITY OF SOUTH <br />BEND, INDIANA, BY ADDING PROVISIONS RELATIVE TO <br />FLOOD PLAIN REGULATIONS. <br />STATEMENT OF PURPOSE AND INTENT <br />Ordinance No. 6330 -78 amending and supplementing Chapter 6 of the <br />Municipal Code of South Bend, generally known as the Building Code of the <br />City, was passed by the Common Council April 24, 1978 and approved and <br />signed by the Mayor April 25, 1978. A study of flood - prone areas within <br />the corporate limits of the City of South Bend, has been completed, <br />delineating flood hazard areas and identifying the floodway and floodway <br />fringe areas- of the St. Joseph River, Bowman Creek., Clyde Creek, and <br />Phillips Ditch in conjunction with the National Flood Insurance Program.. <br />It is in the public interest to control development so a,s to minimize or <br />eliminate existing or potential flood hazards. Ordinance 6330-78 co.ntatned <br />in Section I thereof reference in the second line to adding Article 7 and <br />the section then added a Flood Plain Code as a part of Article 7. The <br />reference to Article 7 was by typographical error and such reference should <br />be to Article 9. The purpose of this Ordinance is to repeal Ordinance <br />6330 -78 and to reenact the Flood Plain Code as a proper part of Arti`cte 9. <br />NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City <br />of South Bend, Indiana: <br />SECTION I. Ordinance No. 6330 -78 amending and supplementing Chapter 6 <br />of the Municipal Code of South Bend, Indiana, generally known as the Building <br />Code of the City of South Bend, Indiana, by adding provisions relative to <br />flood plain regulations, passed by the Common Council April 24, 1978 and approved. <br />and signed by the Mayor April 25, 1978, is hereby repealed. <br />SECTION II. Chapter 6 of the Municipal Code of South Bend, Indiana, <br />be amended by adding Article 9 as follows: <br />Article 9 FLOOD PLAIN CODE <br />Sec. 6 -38 Definitions <br />(a) As used in this Article: <br />(1) Floodproofing - a combination of structural and non - structural <br />additions, changes or adjustments to properties and structures <br />which maintain a dry interior and eliminate flood damage to <br />lands, water and sanitary facilities, structures and contents <br />of buildings. <br />(2) Improvement Location Permit - a permit issued by the Building <br />Commissioner in accordance with the provisions of this <br />Ordinance prior to.the erection or alteration and use of a <br />building or structure or use of land, stating that the <br />proposed building, structure, and /or uses comply with all <br />applicable provisions of this Ordinance. <br />
