COMMITTEE OF THE WHOLE DECEMBER 11, 1967
<br />Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Committee of the
<br />Whole in the Council Chambers of City Hall on Monday, December 11, 1967, at 8 :00 P.M., with all members
<br />present. The meeting was called to order by Chairman Edwin T. Smith, who presided. Chairman Smith introduced
<br />Reverend Thaddeus A. Kwak, St Adalberts Church, who gave the invocation.
<br />ORDINANCE
<br />AN ORDINANCE AMENDING ORDINANCE NO. 3702 COMMONLY
<br />KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH
<br />BEND, INDIANA. (Location :. N. line of first alley
<br />N. of E. Jefferson at intersection with Logan).
<br />This being the time heretofore set for public hearing on the above Ordinance proponents and opponents were
<br />given an opportunity to be heard thereon. Speaking in favor of the Ordinance were: Robert Zimmerman,
<br />attorney for the petitioners and Edmund Brown, Vice President and General Manager of Yeager Motor Company.
<br />Speaking against the ordinance were: Mr. Donald Andrzejewski, 326 S. 36th Street, who presented the Clerk
<br />with a remonstrance petition bearing the names of nearby property owners who were not in favor of the
<br />Ordinance; Mrs. Merrill Ramsey, 303 S. 36th Street and Mrs. Philip Jones, 1012 Borley St., Mishawaka, Indiana.
<br />Councilman Szymkowiak made a motion that the Ordinance be referred back to the Area Plan Commission.
<br />Councilman Muszynskil seconded the motion. Motion failed, 8 nays,(Councilmen Hunter, Allen, Palmer, Wise,
<br />Geib, Laven, Smith and Muszynski), 1 aye, (Councilman Szymkowiak) Councilman Hunter then made a motion
<br />that the Ordinance go to the Council as unfavorable. Councilman Wise seconded the motion. Motion carried,
<br />8 ayes, (Councilmen Hunter, Allen, Palmer, Wise, Geib, Laven, Smith and Muszynski), 1 nay, (Councilman
<br />Szymkowiak).

<br />AN ORDINANCE AMENDING ORDINANCE NO. 3702 COMMONLY
<br />KNOWN AS THE ZONING ORDINANCE. (Location: 150 E
<br />North Shore Dr.)
<br />This being the time :heretofore set for public hearing on the above Ordinance proponents and opponents were
<br />given an opportunity to be heard thereon. Speaking in favor of the Ordinance was F.J. Nimtz, attorney for
<br />the petitioners. Speaking against the Ordinance were Paul Finfer, 140 E. North Shore Dr., and Edwin-Howard,
<br />124 E. North Shore Drive. Councilman Allen made a motion that the Ordinance go to the Council as unfavorable.
<br />Councilman Szymkowiak seconded the motion. Motion carried.

<br />AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 40
<br />OF THE MUNICIPAL CODE OF SOUTH BEND, INDIANA.
<br />(Location: S.W. Corner Ironwood and Ridgedale).
<br />This being the time heretofore set for public hearing on the above Ordinance proponents and opponents were
<br />given an opportunity to be heard thereon. Speaking in favor of the Ordinance were Joseph T. Helling, attorney
<br />for the petitioners; George St. Clair, 1955 Piedmont, Paul Peterson; 1949 Piedmont; Kenneth McKelvey, 1933
<br />Piedmont; Ronald Silverman, 1975 Briarway; Clare Hitchcock, 3113 Weist Lane; George Priebe, 1918 Piedmont;
<br />Emil Reznick, 3040 Woodmont and J. Frank Hartwig, 1959 Piedmont, who submitted a petition bearing the names
<br />of 68 property owners in the nearby area who were in favor of the rezoning. Chairman Smith submitted commun-
<br />ications from property owners: L.G. Roll and Henry S. Badet, Jr in support of the rezoning. Speaking
<br />against the Ordinance were Thomas L. Lewis, attorney for the reomonstrators, who submitted to the Clerk a
<br />petition bearing the names of 392 remonstrators. Also speaking in remonstrance were: Earl E. Troeger, Jr.;
<br />3047 Woodmont; John Lauder, 3055 Woodmont; H.C. Overgaard, 1958 Briar.:Way; Don Clare, 1904 Ridgedale;
<br />Mrs. John Lauder, 3055 Woodmont; Morris Wagner 1940 Briar Way, Lawrence Vogt, 1903 Piedmont; John Funston,
<br />1840 Ridgedale; Elmer Richards, 2912 York Rd; �ayne Brown, 1927 Briar Way; Jack Miles, 1964 Briar Way;
<br />Dennis Hartzall; 1952 Briar Way; Vern Jessup, 2830 Sampson and Gerald Reinke, 1221 Ridgedale Rd. Chairman
<br />Smith then relinquished his.seat as Chairman of the Committee of the Whole to John L. Hunter, Jr., President
<br />of the Council. Mr. Smith explained his reason for leaving his seat was in order that he could speak
<br />on the floor of the Council Chamber as a member of the Council and also as the Councilman of the fifth
<br />district. He then pointed out various reasons why he felt the Ordinance would be favorable. Councilman
<br />Smith then made a motion that the Ordinance be amended in Section 1 to include the more detailed legal
<br />description of the property as it appears on the original peition, and to delete the description now
<br />appearing on the Ordinance. 'Councilman Laven seconded the motion. Motion carried, 8 ayes, (Councilman
<br />Hunter, Allen, Palmer, Wise, Geib, Szymkowiak, Laven and Smith), 1 nay, (Councilman Muszynski). Councilman
<br />Smith made a motion.that the Ordinance go to the Council favorable, as amended. Councilman Laven seconded
<br />the motion. Motion carried, 8 ayes, (Councilmen Hunter, Allen, Palmer, Wise, Geib, Szymkowiak, Laven
<br />and Smith), 1 nay (Councilman Muszynski). There were two recesses during the meeting. The first recess
<br />was at 10 :50 P.M. Reconvened: 11:10 P.M. The second recess occurred at 12 :05 A.M., Reconvened: 12 :10 A.M.
