REGULAR MEETING August 28, 1967 <br />- -- <br />Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Council Chambers <br />in City Hall on Monday, August 28, 1967,at 10 :37 P.M. All members were present, except Councilman Muszynski. <br />The meeting was called to order by President John L. Hunter, Jr., who presided. <br />ROLL CALL <br />PRESENT Councilmen Hunter, Allen, Palmer, Wise, Geib, <br />Szymkowiak, Laven and Smith <br />ABSENT Councilman Muszynski <br />REPORT OF COMMITTEE ON MINUTES <br />To the Common Council of the City of South Bend: <br />Your Committee on the inspection and supervision of the minutes would respectfully report that they have <br />examined the minutes of the previous meeting of the Council and found them correct. They therefore recommend <br />that the same be approved. <br />/s/ John L. Hunter, Jr. <br />/s/ Janet S. Allen <br />/s/ Albert E. Palmer <br />Meeting of August 14, 1967. <br />There being no objections, the report was accepted as read, and placed on file. <br />PETITION <br />We, the undersigned, do hereby respectfully make application and petition the Common Council, City of <br />South Bend to amend the Zoning Ordinance of the City of South Bend, Common Council as hereinafter requested, <br />and in support of this application, the following facts are shown: <br />1. The property sought to be rezoned is located: <br />North of Washington Street and East of Falcon Street in the North Part of Northeast of Northeast <br />k of Section 9, T 37, R2E, City of South Bend, Pottage Township, Saint Joseph County, Indiana. <br />2. The property is owned by <br />City of South Bend, Department of Redevelopment <br />Mutual Commercial Company <br />Wiley Hoover <br />3. A legal description of the property is as follows: <br />A tract of land in the Northeast Quarter(k)of the Northeast Quarter (k) of Section 9, Township 37 North, <br />Range 2 East described as follows: Beginning at a point Thirty -one and Six tenths (31.6) feet North <br />of the Southeast corner of the Northeast (k) of the Northeast ('k) of said Section 9, said point being <br />on the North line of Washington Street as shown on the recorded Plat of LaSalle Park Second Addition; <br />thence West along the North line of said Washington Street a distance of 857.9 feet to the West line of <br />Lake Street produced North from said LaSalle Park Second Addition; thence North along the East line of <br />Lake Street a distance of 240 feet; thence East and along a line 240 feet North of and parallel to the <br />North line of Washington Street a distance of 857.9 feet more or less to the East line of the Northeast <br />Quarter (k) of said Section 9; thence South along the East line of said Quarter (k) Section a distance <br />of 240 feet to the place of beginning. <br />All of a tract of land Forty -six (46) feet off and from the entire South end of Lot Numbered 1088 <br />as shown on the recorded Second Plat of LaSalle Park Addition to the City of South Bend. All of Lot <br />Numbered 1089 as shown on the recorded Second Plat of LaSalle Park Addition to the City of South Bend. <br />A tract 129 feet East and West by 162 feet North and South described as beginning 254 feet North of <br />the Northeast corner of the Intersection of Washington Street and Falcon Street; thence North 162 feet; <br />thence East 129 feet; thence South 162 feet; thence West 129 feet to the place of beginning, being part <br />of Lot Numbered 1087 as shown on the recorded Second Plat of LaSalle Park Addition to the City of South <br />Bend, Indiana. <br />4. It is desired and requested that the foregoing property be rezoned: <br />from "C" Commercial and "E" Height and Area District to "B" Residential <br />and "A" Height and Area District. <br />5. It is proposed that the property will be put to public use for park and recreational purposes including <br />a community building to be located approximately in the vicinity of Lake and Washington Streets. <br />6. Number of off street parking spaces to be provided <br />Ample spaces to comply with the Urban Renewal Plan and the <br />requirements of the Zoning Standards, City of South Bend. <br />7. Attached is a copy of: a.) an existing plot plan showing petitioners property and other surrounding <br />properties; b.) names and addresses of all the individuals, firms or corporations owning property <br />within 300 feet of the property sought to be rezoned: c.) site development plan. <br />/s/ Howard Bellinger.
