COMMITTEE OF THE WHOLE MEETING JANUARY 9, 1967 <br />Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Committee of the Whole <br />in the Council Chambers in the City Hall on Monday, January 9, 1967 at 8 :00 P.M. All members were present <br />except Councilman Wise. The meeting was called to order by Chairman Edwin T. Smith, who presided. <br />Chairman Smith introduced Reverend Harry 0. Huffman, pastor of Lydick Bethel Church, who gave the invocation. <br />ORDINANCE <br />AN ORDINANCE AMENDING SECTION 40 -17 OF THE MUNICIPAL <br />CODE OF THE CITY OF SOUTH BEND, INDIANA, 1962 AS <br />AMENDED, ALSO KNOWN AS SECTION 4 OF ORDINANCE NO. <br />3702, THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, <br />INDIANA, AS AMENDED. <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were <br />given an opportunity to be heard thereon. Chairman Smith read the following communication: <br />The Honorable Common Council <br />City of South Bend <br />South Bend, Indiana <br />January 6, 1967 <br />Gentlemen: <br />The attached ordinance which was referred back to the Area Plan Commission for clarification has now been <br />discussed with the Area Plan Attorney. n order to clarify this proposed amendment,it is suggested <br />that the last sentence read as follows: <br />"In the event the Board does approve the petition, the approval <br />shall be subject to the development plan approved by the Board <br />of Zoning Appeals and such plan shall constitute a limitation <br />on the use of the property ". <br />If you have any further questions on this matter, please contact our office. <br />Very truly yours, <br />John K. Wilson <br />Executive- Director <br />Councilman Allen made a motion that the Ordinance be amended as suggested by the Area Plan Commission. Council- <br />man Muszynski seconded the motion. Motion carried. Councilman Laven made a motion that the Ordinance go <br />to the Council favorable, as amended. Councilman Muszynski seconded the motion. Motion carried. <br />ORDINANCE <br />AN ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA <br />APPROPRIATING THE SUM OF ONE MILLION FIVE HUNDRED <br />THOUSAND DOLLARS ($1,500,000) FOR THE ACQUISITION <br />OF LAND, EASEMENTS AND RIGHTS -OF -WAY AND THE CON- <br />STRUCTION THEREON OF MAJOR ARTERIAL STREETS TO <br />EXTEND THE INNER BELT SYSTEM; FOR THE CON- <br />STRUCTION AND EQUIPPING OR THE REMODELING AND <br />EQUIPPING OF A BUILDING FOR USE AS A FIRE <br />STATION AND THE ACQUISITION, IMPROVEMENT AND <br />LANDSCAPING OF ANY LAND NECESSARY AS A SITE THERE- <br />FOR; CONSTRUCTION OF SEWERS; CONSTRUCTION, <br />RECONSTRUCTION AND IMPROVING OF STREETS; AND <br />THE ENGINEERING, ARCHITECTURAL, APPRAISAL, <br />ABSTRACTING, TITLE INSURANCE AND LEGAL FEES <br />AND EXPENSES INCIDENTAL THERETO AND THE <br />EXPENSES AND LEGAL FEES ON ACCOUNT OF THE <br />ISSUANCE OF BONDS THEREFOR AND DECLARING <br />THAT AN EXTRAORDINARY EMERGENCY EXISTS FOR THE <br />EXPENDITURE OF SAID FUNDS. <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were <br />given an opportunity to be to be heard thereon. Speaking in favor of the Ordinance was Mr. Lloyd Taylor, <br />City Engineer. Speaking against the Ordinance was Councilman Janet S. Allen. Councilman Hunter made a <br />motion that the Ordinance go to the Council as favorable. Councilman Palmer seconded the motion. Motion <br />carried. <br />
