Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Committee of the Whole
<br />in the Council Chambers in the City Hall on Monday, October 10, 1966 at 8:00 P.M. The meeting was called to
<br />order by Chairman Edwin Thomas Smith, who presided. All members were present.
<br />Chairman Smith introduced Reverend J. Robert Clark, Associate Pastor of Grace Methodist Church, who gave the
<br />invocation.

<br />AN ORDINANCE AMENDING SECTIONS 40 -1 AND 40 -17 OF THE
<br />MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, 1962,
<br />AS AMENDED, ALSO KNOWN AS ORDINANCE NO 3702, THE
<br />ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA,
<br />AS AMENDED.
<br />Public hearing on the above Ordinance was continued from the meeting of September 26, 1966. Councilman Hunter
<br />reported that the Ordinance Committee recommended that the Ordinance be sent back to the Area Plan Committee
<br />for further study, and that an unfavorable report be given it in its present form. The following report was
<br />read by Councilman Hunter: Report of Ordinance Committee: "The Ordinance Committee, following a meeting, recom-
<br />mends that the above Ordinance goes to Council unfavorably, It also recommends that the Ordinance be defeated bas
<br />on John Wilson's recommendations. Our recommendations are based on the need for changes in the Ordinance partic-
<br />ularly in the area sizes of certain height and area districts. Consideration should also be given to other facts
<br />in the ordinance that were not fully considered ". Councilman Hunter made a motion that the Ordinance go to the
<br />Council as unfavorable. Councilman Geib seconded the motion. Motion carried.

<br />AN ORDINANCE AMENDING SECTION 40 OF THE MUNICIPAL CODE
<br />OF THE CITY OF SOUTH BEND, INDIANA OF 1962, MORE
<br />SPECIFICALLY KNOWN AS ORDINANCE NO. 4608-63-ADOPTED
<br />BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND
<br />ON OCTOBER 14, 1963, AND COMMONLY KNOWN AS THE
<br />ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA. (Location: 3004 Edison Rd.)
<br />This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were
<br />given an opportunity to be heard thereon. Speaking in favor of the Ordinance was Joseph Ettl, attorney for
<br />the petitioner. Speaking in remonstrance were: David Good, 2923 McArthur Dr., who submitted the names of
<br />100 neighbors in the surrounding area who are opposed to the Ordinance. Also, James Wright, 2911 McArthur,
<br />Lee Patterson, 2919 McArthur, and James Widner, 3112 Kettering Drive. Councilman Hunter made a motion that
<br />the Ordinance go to the Council as unffavorable. Councilman Wise seconded the motion. The motion failed, 7 nays,
<br />2 ayes (Councilmen Hunter and Wise). Councilman Geib then made a motion that the Ordinance go to the Council
<br />as favorable. Councilman Muszynski seconded the motion. Motion carried, 7'ayes, 2'nays (Councilmen Hunter and
<br />Wise).

<br />AN ORDINANCE APPROVING A CONTRACT BETWEEN THE WATER
<br />WORKS OF THE CITY OF SOUTH BEND AND HERSEY - SPARLING
<br />METER COMPANY FOR THE FURNISHING OF A 12 INCH TURBINE
<br />TYPE WATER METER. IN THE SUM OF $3,057.95.
<br />This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given
<br />an opportunity to be heard thereon. Speaking in favor of the Ordinance was Howard Goodhew, Water Works Super-
<br />intendent. Councilman Laven made a motion that the Ordinance go to the Council as favorable. Councilman Geib
<br />seconded the motion. Motion carried.
