_REGULAR MEETING JULY 26 1966 PETITION The undersigned, do hereby respectfully make application and petition the Common Council of the City of South Bend, Indiana to amend the zoning Ordinance of the City of South Bend, Indiana as hereinafter requested, and in support of this application, the following facts are shown: 1. The property sought to be rezoned is located at approximately 3911 -17 S. Michigan Street, South Bend, Indiana. 2. The property is owned by Estelle C. Cover 3. A legal description of the property is as follows: Three Hundred (300) feet in width, North and South, off of the entire South Side of the Chippewa Knoll Realty owned by Seller in South Bend, Indiana, which Chippewa Knoll realty is the real estate owned by Seller and described as follows: Beginning at the intersection of the South line of Chippewa Avenue and the Westerly line of South Michigan Street; thence Southerly on the Westerly line of said South Michigan Street a distance of 735 feet, more or less, to the North line of Lot No. 69 in Chippewa Heights Third Addition in South Bend, Indiana;thence West along the North Line of Lot No. 69 and Lot No. 108 in said Chippewa Heights Third Addition to the Easterly line of South Main Street; thence North along the Easterly line of South Main Street to the South line of Chippewa Avenue; thence East along the South line of Chippewa Avenue to the point of beginning. 4. It is desired and requested that the foregoing property be rezoned: From "B Residential Use and B Height and Area District To: "C" Commercial Use and A Height and Area District. 5. It is proposed that the property will be put to the following use and the following building will be constructed: One story building for the use of Restaurant and Bar. 6. Number of off street parking spaces to be provided: 103 7. Attached is a copy of: a.) an existing plot plan showing my property and other surrounding properties; b.) names and addresses of all the individuals, firms or corporations owning property within 300 feet of the property sought to be rezoned; c.) site development plan /s/ Robert L. Councilman Smith seconded the motion. Motion carried. REPORT OF COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole to whom was referred "AN ORDINANCE TO AMEND SECTION 11 OF ORDINANCE NO. 4838 -66 ENTITLED "AN ORDINANCE REPEALING CHAPTER 36 OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, 1962, RELATING TO TAXICABS AND OTHER VEHICLES; AND ENACTING AN ORDINANCE REGULATING TAXICABS AND OTHER VEHICLES; LICENSING TAXICABS AND TAXICAB DRIVERS;PROVIDING FOR TAXICAB STANDS ON THE PUBLIC STREETS;PROVIDING PENALTIES FOR THE VIOLATION THEREOF" Respectfully report that they have examined the matter and that in their opinion the Ordinance go to the Council favorable, as amended. OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole to whom was referred "AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 40 OF THE MUNICIPAL CODE OF SOUTH BEND, INDIANA (N.E. Corner of Ironwood and Colfax)" Respectfully report that they have examined the matter and that in their opinion the.Ordinance go to the Council as unfavorable. /s/ Edwin Thomas Smith, Chairman There being no objections, the report was accepted and placed on file.
