Igo COMMITTEE OF THE WHOLE MEETING APRIL 25, 1966 Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Committee of the Whole in the Council Chambers in the City Hall on Monday, April 25, 1966, at 8:00 P.M., with all members present, except Councilman Muszynski. The meeting was called to order by Chairman Edwin T. Smith, who presided. ORDINANCE AN ORDINANCE REPEALING SUB - SECTION (b) OF SECTION ONE (1) OF ORDINANCE NO. 3964 BEING AN ORDINANCE FIXING THE SCHEDULE OR RATES AND CHARGES TO BE COLLECTED BY THE CITY OF SOUTH BEND FROM THE OWNERS OF PROPERTY SERVED BY THE SEWAGE DISPOSAL WORKS OF SAID CITY AND OTHER MATTERS CONNECTED THERE- WITH; AND SUBSTITUTING A NEW SUB - PARAGRAPH (b) IN SAID SECTION ONE (1) IN LIEU THEREOF. This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. The public hearing was continued from the meeting of April 11, 1966. Mr. Dan Clark, President of the Downtown Council and a member of the South -Bend Mishawaka Area Chamber of Commerce spoke in favor of the Ordinance. Mr. Lloyd Taylor, City Engineer explained the purpose of the Ordinance. Mr. Don Carter, representing The Bendix Corporation spoke against the Ordinance. Councilman Allen made a motion for a recess. Councilman Wise seconded the motion. Motion carried and Council was recessed at 8:25 P.M. Reconvened at 8:30 P.M. Councilman Wise made a motion that the Ordinance go to the Council as favorable. Councilman Palmer seconded the motion. Motion carried. ORDINANCE AN ORDINANCE REGULATING THE PUBLIC DISPOSAL OF GARBAGE AND RUBBISH ON ANY LAND WHICH IS SITUATED WITHIN THE CORPORATE LIMITS OF THE CITY OF SOUTH BEND, INDIANA, REQUIRING PER- MITS AND LICENSES AND PROVIDING PENALTIES FOR VIOLATIONS THEREOF. This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Councilman Allen offered the following amendments: Section I, paragraph 2, line 2 - Change the word "effects "to "affects ". Section III, (b) - After the words "as of ", the words "date of passage of this Ordinance" should be filled in the blank space. Section III, (e), line 3 - Section 202 should be changed to 3 -C Section V, (c), line 2 - (a) - should be changed to (b) Section V, (k), paragraph 2, line 4. - Delete the words "and appropriate Plan Commission and /or Board of Zoning Appeals ". Councilman Allen made a motion that the amendments be accepted. Councilman Wise seconded the motion. Motion carried. Councilman Hunter made a motion that the Ordinance go to the Council favorable, as amended. Council- man Laven seconded the motion. Motion carried.
