Igo <br />COMMITTEE OF THE WHOLE MEETING <br />APRIL 25, 1966 <br />Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Committee of the <br />Whole in the Council Chambers in the City Hall on Monday, April 25, 1966, at 8:00 P.M., with all members present, <br />except Councilman Muszynski. The meeting was called to order by Chairman Edwin T. Smith, who presided. <br />ORDINANCE <br />AN ORDINANCE REPEALING SUB - SECTION (b) OF SECTION <br />ONE (1) OF ORDINANCE NO. 3964 BEING AN ORDINANCE <br />FIXING THE SCHEDULE OR RATES AND CHARGES TO BE <br />COLLECTED BY THE CITY OF SOUTH BEND FROM THE OWNERS <br />OF PROPERTY SERVED BY THE SEWAGE DISPOSAL WORKS <br />OF SAID CITY AND OTHER MATTERS CONNECTED THERE- <br />WITH; AND SUBSTITUTING A NEW SUB - PARAGRAPH (b) <br />IN SAID SECTION ONE (1) IN LIEU THEREOF. <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were <br />given an opportunity to be heard thereon. The public hearing was continued from the meeting of April 11, 1966. <br />Mr. Dan Clark, President of the Downtown Council and a member of the South -Bend Mishawaka Area Chamber of <br />Commerce spoke in favor of the Ordinance. Mr. Lloyd Taylor, City Engineer explained the purpose of the <br />Ordinance. Mr. Don Carter, representing The Bendix Corporation spoke against the Ordinance. Councilman <br />Allen made a motion for a recess. Councilman Wise seconded the motion. Motion carried and Council was <br />recessed at 8:25 P.M. Reconvened at 8:30 P.M. Councilman Wise made a motion that the Ordinance go to the <br />Council as favorable. Councilman Palmer seconded the motion. Motion carried. <br />ORDINANCE <br />AN ORDINANCE REGULATING THE PUBLIC DISPOSAL <br />OF GARBAGE AND RUBBISH ON ANY LAND WHICH IS <br />SITUATED WITHIN THE CORPORATE LIMITS OF THE <br />CITY OF SOUTH BEND, INDIANA, REQUIRING PER- <br />MITS AND LICENSES AND PROVIDING PENALTIES <br />FOR VIOLATIONS THEREOF. <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were <br />given an opportunity to be heard thereon. Councilman Allen offered the following amendments: <br />Section I, paragraph 2, line 2 - Change the word "effects "to "affects ". <br />Section III, (b) - After the words "as of ", the words "date of passage of this Ordinance" <br />should be filled in the blank space. <br />Section III, (e), line 3 - Section 202 should be changed to 3 -C <br />Section V, (c), line 2 - (a) - should be changed to (b) <br />Section V, (k), paragraph 2, line 4. - Delete the words "and appropriate Plan Commission and /or <br />Board of Zoning Appeals ". <br />Councilman Allen made a motion that the amendments be accepted. Councilman Wise seconded the motion. Motion <br />carried. Councilman Hunter made a motion that the Ordinance go to the Council favorable, as amended. Council- <br />man Laven seconded the motion. Motion carried. <br />
