COMMITTEE OF THE WHOLE MEETING FEBRUARY 28, 1966
<br />Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Committee of the
<br />Whole in the Council Chambers in the City Hall on Monday, February 28, 1966 at 8:�O P.M., with all members
<br />present except Councilman Wise. The meeting was called to order by Chairman Edwin T. Smith, who presided.
<br />Chairman Smith introduced Reverend O,D,,,,. Wissler of Central Evangelical United Brethern Church, who gave
<br />the invocation.
<br />ORDINANCE
<br />AN ORDINANCE AMENDING ORDINANCE NO. 3702
<br />ADOPTED BY THE COMMON COUNCIL OF THE CITY
<br />OF SOUTH BEND, COMMONLY KNOWN AS THE
<br />ZONING ORDINANCE(Location: Southeast
<br />Corner of McKinley Ave. and Eddy St.)
<br />This being the time heretofore set for public hearing on the above ordinance, proponents and opponents were
<br />given an opportunity to be heard thereon. Speaking in favor of the ordinance was Mr. Russell Fisher, attorney
<br />representing Homestead Developers, Marathon Oil Co., Mrs. bydla;Johnson and C. E. Bullard, Inc. Also
<br />speaking in favor of the ordinance was Mr. Joseph Bullard, President of Homestead Developers.
<br />Councilman Hunter made a motion that the ordinance go to the Council as unfavorable. Councilman Szymkowiak
<br />seconded the motion. Motion failed for want of a majority, 4 ayes (Councilmen Hunter, Geib, Allen and
<br />Szymkowiak). 4 nays (Councilmen Muszynski, Laven, Smith and Palmer) 1 absent (Councilman Wise)
<br />Councilman Allen made a motion that the public hearing be continued at the next meeting, which will be
<br />held March 14, 1966. Councilman Palmer seconded the motion. Motion carried 5 ayes (Councilmen Allen, Palmer,
<br />Laven, Smith and Muszynski), 3 nays (Councilmen Geib, Hunter and Szymkowiak) 1 absent (Councilman Wise).
<br />ORDINANCE
<br />AN ORDINANCE AMENDING ARTICLE I, SECTION 19 -6,
<br />OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND,
<br />INDIANA, 1962, THE SAME PERTAINING TO HOTELS,
<br />LODGING HOUSES AND ROOMING HOUSES AND THE RIGHT
<br />OF THE ENTRY OF INSPECTORS.
<br />This being the time heretofore set for public hearing on the above ordinance, proponents and opponents were
<br />given an opportunity to be heard thereon. Councilman Allen made a motion that the ordinance go to the
<br />Council as favorable. Councilman Szymkowiak seconded the motion. Motion carried.

<br />AN ORDINANCE TO REPEAL ORDINANCE NO. 4803 -65
<br />(Southeast Annexation)
<br />This being the time heretofore set for public hearing on the above ordinance, proponents and opponents were
<br />given an opportunity to be heard thereon. Councilman Geib made a motion that the ordinance go to the
<br />Council as favorable. Councilman Hunter seconded the motion. Motion carried.
<br />ORDINANCE
<br />AN ORDINANCE REPEALING CHAPTER 36 OF THE MUNICIPAL CODE
<br />OF THE CITY OF SOUTH BEND, INDIANA, 1962, RELATING TO
<br />TAXICABS AND OTHER VEHICLES: AND ENACTING AN ORDINANCE
<br />REGULATING TAXICABS AND OTHER VEHICLES: LICENSING TAXICABS
<br />AND TAXICAB DRIVERS: PROVIDING FOR TAXICAB STANDS ON
<br />THE PUBLIC STREETS: PROVIDING PENALTIES FOR THE
<br />VIOLATION THEREOF.
<br />This being the time heretofore set for public hearing on the above ordinance, proponents and opponents were
<br />given an opportunity to be heard thereon. Speaking against various points in the ordinance was Mr. Richard
<br />Doyle, attorney, representing the Tel -A -Cab Company. Speaking in favor of the ordinance was Mr.
<br />John Montgomery, attorney representing Indiana Cab Company and South Bend Cab Company. Councilman Geib
<br />made a motion that the ordinance be sent to the Ordinance Committee. Councilman Palmer - seconded the motion.
<br />Motion carried.
<br />There being no further business before the Committee of the Whole, Chairman Smith directed the members
<br />of the Committee/ to ise and report to the Council. Time :9:20 P.M.
