301 <br />�DMMITTEE OF THE WHOLE — - JANUAR _196b_ <br />Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Committee of the Whole <br />in the Council Chambers in the City Hall on Monday, January 24, 1966, at 8:00 P.M., with all members present. <br />The meeting was called to order by Councilman Edwin T. Smith, who presided. <br />man <br />Council/ Smith introduced Reverend W. D. Oberholtzer of Trinity Lutheran Church, who gave the Invocation. <br />ORDINANCE <br />AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE <br />NO. 3702 OF THE CITY OF SOUTH BEND, INDIANA (Affecting <br />21 Acre Tract at Northwest corner of McKinley Highway <br />and Hickory Road) <br />This being the time heretofore set for public hearing on the above ordinance, proponents and opponents <br />were given an opportunity to be heard thereon. Speaking in favor of the ordinance was Joseph T. Helling <br />Attorney; representing the petitioners,(John and Rose Weingarten, Philip and Rachel Pelissier, Arnold <br />and Carolyn Joers) and L.S. Ayers, Department Store. Also, speaking in favor of the ordinance was Robert <br />Jones, 3409 McKinley, and John K. Wilson, Executive Director of the Area Plan Commission. <br />Douglas D. Seeley, Jr.,Attorney spoke against passage of the ordinance,,and presented a list of signatures <br />of petitioners against the ordinance. Also speaking against the ordinance were: <br />Edward Gonter <br />Thomas Smith <br />Roger Bock <br />Gerald Johnson <br />Mrs. Arthur Bry <br />Arthur Lake <br />Daniel Osberger <br />John MacLeod <br />Helen Simon <br />Norman Rosma <br />Kenneth Martin <br />John McGlinchey <br />- 534 Preston Dr. <br />- Pastor of Christian Reformed Church <br />- 3505 Winding Dr. <br />- 229 Wildemere Dr. <br />son - 211 N. Timber Lane <br />- 604 Preston Dr. <br />- 336 Preston Dr. <br />- 930 Simon Ct. <br />- 3248 Essex <br />- 1645 Brookfield <br />- 3422 Sorin <br />- 741 Patterson Dr. <br />Councilman Laven made a motion for recess. Councilman Wise seconded the motion. Motion carried, and <br />Council recessed. Time: 10 :30 P.M. <br />Meeting reconvened at 10:45 P.M. <br />Councilman Laven made a motion that the ordinance go to the Council as favorable. Councilman Szymkowiak <br />seconded the motion. Motion carried by a vote of 7 ayes, 2 nays. (Councilmen Wise and Geib). <br />ORDINANCE <br />AN ORDINANCE AMENDING ORDINANCE NO. 3702, ADOPTED <br />BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, <br />INDIANA, ON THE 14th DAY OF JUNE, 1949, COMMONLY <br />KNOWN AS THE ZONING ORDINANCE OF THE CITY OF <br />SOUTH BEND (East side of Twyckenham between Corby <br />and Campeau). <br />This being the time heretofore set for public hearing on the above ordinance, proponents and opponents <br />were given an opportunity to be heard thereon. Speaking in favor of the ordinance, and representing <br />the petitioner A. Harold Weber was William Hosinski, Attorney. Speaking against the ordinance were: <br />Don E. Burns <br />Bill Lucky <br />Alonzo Watson <br />Francis Martin,Jr. <br />Marcus L. Lake <br />1507 Corby <br />907 N. Twyckenham <br />1435 Corby <br />710 N. Twyckenham <br />924 N. Twyckenham <br />Councilman Geib made a motion that the ordinance go to the Council as favorable. Councilman Szymkowiak <br />seconded the motion. Motion defeated 4 ayes, 5 nays. Councilman Hunter then made a motion that the <br />ordinance go to the Council as unfavorable. Councilman Wise seconded the motion. Motion carried, <br />5 ayes, 4 nays. <br />There being no further business before the Committee of the Whole, Councilman Wise made a motion to rise <br />and report to the Council.
