<br />Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Committee of the Whole
<br />in the Council Chambers in the City Hall on Monday, December 13, 1965, at 8:05 P.M., with all members present.
<br />The meeting was called to order by Councilman Edwin Thomas Smith, Chairman, who presided.
<br />Councilman Smith introduced Reverend Clair D. Siple of St. Pauls Memorial Methodist Church, who gave the
<br />Invocation.
<br />ORDINANCE
<br />ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE
<br />3702, AS HERETOFORE AMENDED AND SUPPLEMENTED (Location:
<br />South side of Western Avenue between Lombardy and Gladstone)
<br />This being time heretofore set for Public Hearing, proponents and opponents were given opportunity to be heard thereon
<br />Councilman Muszynski made a motion that the Ordinance go to the Council as favorable. Councilman Szymkowiak
<br />seconded the motion. Motion carried

<br />AN ORDINANCE REPEALING CHAPTER 12 OF THE MUNICIPAL CODE OF
<br />THE CITY OF SOUTH BEND, INDIANA, 1962, BEING ORDINANCE NO.
<br />j 4091 RELATING TO FAIR EMPLOYMENT PRACTICES: AND ENACTING
<br />AN ORDINANCE PROVIDING FOR THE PROHIBITION OF DISCRIMINATION
<br />IN EMPLOYMENT BECAUSE OF RACE, COLOR, RELIGION, NATIONAL
<br />ORIGIN OR ANCESTRY BY EMPLOYERS, EMPLOYMENT AGENCIES, LABOR
<br />j ORGANIZATIONS AND OTHERS, AND FURTHER PROVIDING FOR THE
<br />CREATION OF THE SOUTH BEND HUMAN RELATIONS AND FAIR EMPLOYMENT
<br />PRACTICES COMMISSION PRESCRIBING ITS DUTIES AND POWERS AND
<br />PROVIDING PENALTIES.
<br />This being time heretofore set for Public Hearing, proponents and opponents were given opportunity to be heard thereon.
<br />Councilman Geib made a motion that the Ordinance be amended, and as Chairman of the Ordinance Committee
<br />proposed a new ordinance including the proposed amendments. Councilman Hunter seconded the motion.
<br />Motion carried. Councilman Allen made a motion to amend Section 11, Paragraph "d`with the addition'
<br />of "as appropriated in the budget by the Common Council ". Councilman Wise seconded the motion. Motion
<br />carried. Councilman Geib made a motion to amend Section 10, Paragraph "e "to reflect from Section 14
<br />to 13. Councilman Laven seconded the motion. Motion carried. Councilman Hunter made a motion
<br />that the Ordinance go to the Council as favorable, as amended. Councilman Wise seconded the motion. Motion
<br />carried.

<br />AN ORDINANCE AMENDING ORDINANCE NO. 3702, COMMONLY
<br />KNOWN AS "THE ZONING ORDINANCE OF THE CITY OF SOUTH
<br />BEND, INDIANA" (OFF STREET PARKING AND LOADING FACILITIES)
<br />This being the time heretofore set for Public Hearing on the above ordinance, proponents and opponents were
<br />given an opportunity to be heard thereon. Speaking in favor of the-ordinance was Mr. John Wilson,
<br />Executive - Director Secretary of the Area Plan Commission. Councilman Szymkowiak made a motion that the
<br />Ordinance go to the Council as favorable. Councilman Allen seconded the motion. Motion carried.

<br />AN ORDINANCE REGULATING THE SPEED OF TRAINS WITHIN
<br />THE MUNICIPAL CITY AND FORBIDDING THE SOUNDING OF
<br />A RAILROAD LOCOMOTIVE WHISTLE OR RAILROAD LOCOMOTIVE
<br />HORN WITHIN THE MUNICIPAL CITY AND REPEALING ALL
<br />ORDINANCES IN CONFLICT THEREWITH.
<br />This being the time heretofore set for Public Hearing on the above ordinance, proponents and opponents were
<br />given an opportunity to be heard thereon. Councilman Allen made a motion that the Ordinance go to the
<br />Council as favorable. Councilman Laven seconded the motion. Motion carried.

<br />AN ORDINANCE AMENDING CHAPTER I, SECTION 12, OF THE
<br />MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA
<br />1962, AS ADOPTED AND CODIFIED ON OCTOBER 14, 1963,
<br />(COMMONLY KNOWN AS THE COUNCILMANIC DISTRICT ORDINANCE
<br />OF THE CITY OF SOUTH BEND): BY DIVIDING THE CITY OF
<br />SOUTH BEND, INDIANA INTO SIX COUNCILMANIC DISTRICTS AND
<br />FIXING THEIR BOUNDARIES: AND PROVIDING FOR THE USE OF
<br />VOTING MACHINES IN ELECTIONS FOR NOMINATING AND ELECTING
<br />OFFICERS OF THE CITY OF SOUTH BEND, AND REPEALING ALL
<br />ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH.
<br />Councilman Hunter made a motion that the Ordinance be stricken from the Public Hearing. Councilman Wise
<br />seconded the motion. Motion carried.

<br />AN ORDINANCE AMENDING ORDINANCE NO. 3232, ADOPTED
<br />BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND,
<br />INDIANA, THEREAFTER AMENDED AND AS ADOPTED AND
<br />CODIFIED OCTOBER_14, 1963, COMMONLY KNOWN AS THE
<br />COUNCILMANIC DISTRICT ORDINANCE OF THE CITY OF
<br />SOUTH BEND.
<br />This being the time heretofore set for Public Hearing, proponents and opponents were given an opportunity
<br />to be heard thereon. Speaking in favor of the Ordinance was George Herendeen, 1734 Sterling Drive and
<br />William E. Voor, Jr., 722 Patterson Drive. Councilman Muszynski made a motion to recess. Councilman
<br />Szymkowiak seconded the motion. Motion failed.�Counoilman Szymkowiak made a motion for a ten minute recess,
<br />ho:;be .indicated by a standing vote. Councilman Allen seconded the motion. The motion failed, 3 ayes
<br />(Councilmen Allen, Muszynski and Szymkowiak), 6 nays, (Councilman Hunter, Palmer, Wise, Geib, Laven and Smith).
<br />Councilman Hunter submitted a list of various errors in the proposed ordinance, and recommended that the
<br />ordinance go to the Council as unfavorable. Councilman Allen pointed out that it toes not provide room for growth
<br />of Districts Two and Three, which is the principal reason for redistricting. Councilman Szymkowiak made a motion
<br />motion that the ordinance go to the Council as favorable. Councilman Muszynski seconded the motion. Motion
<br />defeated, 2 ayes(Councilmen Szymkowiak and Muszynski) 7 nays (Councilmen Hunter, Allen,Palmer,Wise,Geib,Laven and
<br />Smith).Cduncilman Hunter made a motion that the Ordinance go to the Council as unfavorable. Councilman Laven
<br />seconded the motion. Motion carried 7 ayes (Councilmen Hunter, Allen, Palmer,Wise,Geib,Laven and Smith).2 nays,
<br />Councilmen Szymkowiak and Muszynski). Councilman Geib made a motion that the ordinance be stricken from the record
<br />and expunged from the file, on a point of order. Motion carried, 7 ayes, 2 nays. There being no further business
<br />before the Committee of the Whole, Councilman Wise made a motion to rise and report to the Council. Councilman
<br />Allen seconded the - motion. Motion carried Time: 9.00 P.M,
