REGULAR MEETING MAY 24 1965 <br />REPORT OF CITY PLANNING COMMISSION <br />May 10, 1965 <br />The Honorable Common Council <br />City of South Bend <br />South Bend, Indiana <br />Gentlemen: <br />The attached petition of the Common Council to annex to the city of South Bend, Indiana an irregular tract of <br />land situated East of Miami Road near Jackson Road and abutting the city limits on its southern boundary was <br />legally advertised under date of April 26, 1965 and given public hearing on May 6, 1965. The following action <br />was taken: <br />After due consideration the Commission found that in their <br />opinion the six determinants of. annexation apply to the area <br />at issue. It was therefore duly moved, seconded, and unanimously <br />carried that the petition be recommended favorably to the Council. <br />Very truly yours, <br />CITY PLANNING COMMISSION <br />Robert L. Huff, /s/ <br />Director of Planning <br />RLH/cf <br />attach. <br />Councilman Allen made a motion that the report be accepted and placed on file. Councilman Muszynski seconded <br />the motion. The following action was taken: <br />After due consideration the Commission found that the proposed <br />zone change would not be in the best interest of the surrounding <br />area; would not constitute the best use of subject land, and <br />would impair proper d"evelgpmerit of surrounding vacant land to <br />the north and to the south. It was therefore duly moved, seconded, <br />and unanimously carried that the petition be recommended unfavorably <br />to the Council. <br />Very truly yours, <br />CITY PLANNING COMMISSION <br />Robert L. Huff, /s/ <br />Director of Planning <br />RLH /cf <br />attach. <br />City Clerk May 11, 1965 <br />City Hall <br />South Bend, Indiana <br />Dear Madam: <br />i <br />I have previously prepared a Petition to the City Planning Commission requesting the rezoning of property <br />belonging to Jake and Rose Weingarten located on Hickory Road off McKinley Highway, being a tract of approximate <br />ten acres. <br />My clients have requested that the matter not be presented to the Common Council, hence no zoning ordinance <br />will be submitted. <br />Will you kindly have the record show that this matter has been withdrawn from consideration at this time. <br />Very truly yours, <br />FKB -.m' /s/ Frederick K. Baer <br />Councilman Muszynski made a motion that the report and letter from Attorney requesting withdrawal of petition <br />be accepted and placed on file. Councilman Allen seconded the motion. Motion carried. <br />
