<br />Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Committee of the Whole
<br />in the Council Chambers in the City Hall on Monday, May 10, 1965, at 8:00 P.M., with all members present
<br />except Councilmen Allen and Glass. The meeting was called to order by Councilman Edwin Thomas Smith, Chairman,
<br />who presided.
<br />Chairman Smith introduced the Reverend Orla Bradford of Broadway Evangelical United Brethren Church, who gave
<br />the invocation.
<br />ORDINANCE
<br />AN ORDINANCE AMENDING ORDINANCE NO. 3702 COMMONLY KNOWN AS
<br />THE ZONING ORDINANCE
<br />(3401 Lincoln Way West)
<br />This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were
<br />given an opportunity to be heard thereon. Speaking in favor of the proposed ordinance were F. Jay Nimtz,
<br />Attorney, representing petitioners, Oden R. and Martha E. Robertson, and Glen Huston of 3635 Lincolnway West.
<br />Councilman Hunter made a motion that the ordinance go to the Council as favorable. Councilman Wise seconded
<br />the motion. Motion carried.

<br />COMMON COUNCIL OF THE CITY OF SOUTH BEND ON THE 14TH DAY
<br />OF JUNE, 1949, COMMONLY KNOWN AS THE ZONING ORDINANCE OF
<br />THE CITY OF SOUTH BEND, INDIANA.

<br />This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were
<br />given an opportunity to be heard thereon. Speaking in favor of the proposed ordinance was Russell Fisher,
<br />Attorney, who represented John T. Hartman and Virginia Pearl HArtmati. Councilman Palmer made a motion
<br />that the ordinance go to the Council as favorable. Councilman Hunter seconded the motion. Motion carried.

<br />AN ORDINANCE AMENDING ZONING ORDINANCE N0, 3702 OF THE CITY OF
<br />SOUTH BEND, AS AMENDED, FOR THE PURPOSE OF CHANGING THE ZONING
<br />OF CERTAIN LAND SITUATED WITHIN THE CITY OF SOUTH BEND, INDIANA.
<br />(Southeast corner of intersection of Miami and Lincolnway East
<br />covering 1114 through 1134 Lincolnway East and 1232 through
<br />1240 Miami)
<br />This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were
<br />given an opportunity to be heard thereon. Speaking in favor of the proposed ordinance was Thomas Roemer,
<br />Attorney, who appeared in behalf of his brother, Charles Roemer, Attorney for petitioners. Speaking against
<br />the proposed ordinance were Mr. and Mrs. C. F. Setterland of 1221 Miami St. and Charles Conrad of 1207 Miami
<br />St. Councilman Hahn made a motion that the ordinance go to the Council as favorable, but withdrew his motion
<br />when Mr. Setterland asked to be heard again.Counczlman Hunter: made a motion that the ordinance go to the
<br />Council as favorable. Councilman Geib seconded the motion. Motion carried.

<br />ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702

<br />This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were
<br />given an opportunity to be heard thereon. Speaking in favor of the proposed ordinance was Robert L. Miller,
<br />Attorney, representing Hartman Builders;,; Inc. and Humble Oil and Refining Company. Speaking against the
<br />proposed ordinance was Edwin Wroblewski of 3427 St. John's Way. Mr. James E. Nichols of 3509 St. John's
<br />Way also remonstrated against the proposed ordinance. Councilman Hunter made a motion that the ordinance be
<br />continued for public hearing until May 24th. Councilman Szymkowiak seconded the motion. Motion carried.

<br />AN ORDINANCE ANNEXING TO AND BRINGING WITHIN THE CITY LIMITS
<br />OF SOUTH BEND, INDIANA, CERTAIN LANDS.

<br />This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were
<br />given an opportunity to be heard thereon. Speaking in favor of the proposed Ordinance for petitioners was
<br />Mr. Warren McGill, Attorney. Councilman Muszynski made a motion that the ordinance go to the Council as
<br />favorable. Councilman Wise seconded the motion. Motion carried.

<br />A RESOLUTION APPROVING A CONTRACT BETWEEN THE SOUTH BEND CITY
<br />WATER WORKS AND THE SEWAGE DISPOSAL PLANT OF THE CITY OF SOUTH
<br />BEND AND ROBERT L. MILLER, AGENT FOR AN UNDISCLOSED PRINCIPAL,
<br />FOR FURNISHING OF WATER AND SEWAGE TREATMENT TO CLAY TOWNSHIP,
<br />ST. JOSEPH COUNTY, INDIANA.
<br />This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were
<br />given an opportunity to be heard thereon. Mr. Robert L. Miller, Agent for undisclosed principal, Party of the
<br />First Part, appeared before the Council. The Clerk read a report from the Capital Improvements Committee, as
