Motion carried. <br />REPORT OF ORDINANCE COMMITTEE <br />To the Common Council of the City of South Bend: <br />January 25, 1965 <br />Your Committee on Ordinances to whom was referred AN ORDINANCE REGULATING THE PUBLIC DISPOSAL OF GARBAGE AND <br />RUBBISH OF ANY LAND WHICH IS SITUATED WITHIN THE CORPORATE LIMITS OF THE CITY OF SOUTH BEND, REQUIRING PERMITS <br />AND PROVIDING PENALTIES FOR VIOLATIONS THEREOF. <br />Respectfully report that they have examined the matter and that in their opinion the ordinance is favorable <br />as amended as follows: <br />Section 1: Article 4; delete "cities" and insert - - -the city---. <br />Article 11; after "burning" insert - - -in excess of 500 lb. per hour - - -. <br />Insert a new Article 12; Business of Refuse Disposal is the operation of any refuse <br />disposal system or method requiring a permit as provided by <br />this ordinance whether or not the operation is for personal <br />benefit or profit. <br />Section 2: Article 2; delete "from the County Health Department" <br />Article 2; second paragraph, delete "County Health Department" and <br />insert -- -City of South Bend - - -; and after "permits? <br />in line 2 insert - -- subject to Article 3, this section - - -; <br />and in line 5 before "appropriate" insert -- -Board of <br />Works of The City of South Bend and the - - -. <br />Article 3; line 11, after "application" insert - - -by the health <br />officer the City of South Bend shall collect a permit <br />fee of $100.00 and - - -; delete "and receipt....Department ". <br />Delete the last sentence of this article. <br />Section 3: Article 1; in the last line after "permit" insert - - -by the health <br />officer - - -; and in the last line of the 2nd paragraph <br />after "Department" insert -- -and another copy shall be <br />filed with the Board of Works of the City of South Bend - - -; <br />plus delete the word "public" in the lst line of the 3rd <br />paragraph and insert - -- refuse - - -. <br />Section 4: Article 12; in the 1st line after "roads" insert -- -about the perimeter <br />and adjacent the landfill operation and leading to the <br />entrance gate - - -. <br />Article 13; delete this article in its entirety and insert therefor <br />—Scavenging will not be permitted. - - -. <br />Section 5: Article 2; delete this article in its entirety and insert therefor <br />-- Sites for" ".:incinerator operations shall be applied for <br />in accordance with the procedure outlined by Section 2, <br />Article 3 of this ordinance. <br />Section 8: Article 1; place a period after "misdemeanor" and delete lines 3 <br />through 11 and insert -- -Each day - -- before "after" on <br />line 12. <br />/s/ Richard G. Motion carried. <br />REPORT OF COMMITTEE OF THE WHOLE <br />To the Common Council of the City of South Bend: <br />January 25, 1965 <br />Your Committee of the Whole to whom was referred "AN ORDINANCE REGULATING THE PRESENCE OF MINORS UNDER THE FULL <br />AGE OF EIGHTEEN (18) YEARS ON PUBLIC STREETS AND OTHER PUBLIC PLACES BETWEEN CERTAIN HOURS, WITH EXCEPTIONS. <br />DEFINING RESPONSIBILITIES OF PARENTS OR GUARDIANS OR OTHER HAVING THE LEGAL CARE AND CUSTODY OF MINORS UNDER THE <br />FULL AGE OF EIGHTEEN (18) YEARS AND PROVIDING FOR PENALTIES AND ARREST FOR VIOLATION THEREOF, DESCRIBING CERTAIN <br />PROCEDURES IN THE APpR=NSION AND PROCESSING OF SUCH MINORS UNDER THE FULL AGE OF EIGHTEEN (18) YEARS AND <br />REPEALING ALL ORDINANCES IN CONFLICT HEREWITH ". <br />Respectfully report that they have examined the matter and that in their opinion the ordinance be held over for <br />further public hearing on February 8 ,1965. <br />Edwin Thomas Smith, Chairman <br />Councilman Allen made a motion that the report be accepted and placed on file.
