l <br />REGULAR MEETING <br />REPORT OF THE COMMITTEE OF THE WHOLE <br />To the Common Council of the City of South Bend: <br />DECEMBER 9, 1963 <br />Your Committee of the-Whole, to whom was referred AN ORDINANCE PROHIBITING DISCRIMINATION IN REAL PROPERTY BECAUSE 0 <br />RACE, COLOR, NATIONAL ORIGIN, RELIGION, OR ANCESTRY BY CERTAIN OWNERS, SELLERS, RENTERS, LESSORS, GRANTORS, LESSEES, <br />GRANTEES, ASSIGNEES, MANAGING AGENTS, REAL ESTATE BROKERS, REAL ESTATE SALESMEN, LENDERS AND OTHERS, PROVIDING FOR <br />THE RENAMING OF THE SOUTH BEND FAIR EMPLOYMENT PRACTICE COMMISSION, PRESCRIBING ADDITIONAL DUTIES AND POWERS, AND <br />PROVIDING PENALTIES, Respectfully report that they have examined the matter and it should remain in the Committee of <br />the Whole. <br />/s/ T. Motion carried. <br />MINORITY REPORT <br />The undersigned members of the Common Council feeling that the Fair Housing Ordinance has been recommended by the <br />Mayor's Bi- Racial Committee and, further, that the same has been supported by 65 clergymen of this City and numerous <br />other civic groups of the City, the combined weight of whose membership represents the great majority opinion of our <br />city, do hereby submit a minority report of dissent from the majority report of the Committee of the Whole which <br />majority report by its recommendation of holding it in committee defeated the demonstrated opinion of South Bend <br />that the ordinance should be enacted. <br />Respectfully submitted, <br />/s/ J. Motion carried. <br />REPORT OF CITY PLANNING COMMISSION <br />December 5,'1963 <br />The Honorable Common Council <br />City of South Bend <br />South Bend, Indiana <br />Gentlemen: <br />In the matter of the petition of Balint, Sipocz, and Vadas for a change of zoning of Lots 1, 2, 3, 19, 20, and 21 <br />of Lincoln Plaza, being between Chicago and Sheridan on the north side of Lincolnway West, the Council received an <br />unfavorable recommendation from the Planning Commission on 8 July, 1963. <br />Chapter 133, Acts of General Assembly 1961 amends the Planning Act; i. e., Chapter 174, Acts of 1947, Section 64 <br />as follows: <br />Failure of the City Council to pass such proposed ordinance by said affirmative vote within ninety (90) .days after <br />its rejection by the plan commission shall constitute rejection of the proposed ordinance and it shall not be <br />reconsidered by the Planning Commission or the City Council until the expiration of one (1) year after date of its <br />original rejection by the Plan Commission. (The said "affirmative vote" referred to above is the statutory require- <br />ment of 75% vote of the Council to override an unfavorable recommendation.) <br />The 90 day time period expired on 8 October, 1963, It would seem eminently clear, therefore, that the subject <br />petition is not at issue. <br />Very truly yours, <br />CITY PLANNING COMMISSION <br />/s/ Robert L. Councilman Tellson seconded the motion. Motion carried. <br />ORDINANCE <br />AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 <br />(Lot 1 of Lincoln Plaza) <br />Councilman Lehman made a motion to withdraw the Ordinance. Councilman Tellson seconded the motion.
