537 <br />COMMITTEE OF THE WHOLE MEETING <br />MARCH 11, 1963 <br />Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Committee of the Whole in <br />the Council Chambers in the City Hall on Monday, March 11, 1963, at 8 :15 P.M., with all members present except <br />Councilman Glass. The meeting was called to order by Councilman T. W. Lehman, Chairman, who presided. <br />ORDINANCE <br />AN ORDINANCE PROVIDING FOR THE ANNEXATION OF CERTAIN <br />TERRITORY TO THE CITY OF SOUTH BEND, INDIANA (Crest Manor -- -37.8 acres South of Jackson <br />and East of Miami) <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an <br />opportunity to be heard thereon. <br />Councilman Kroll made a motion that the Ordinance go to the Council as favorable. Councilman Muszynski seconded the <br />motion. Motion carried. <br />ORDINANCE <br />AN ORDINANCE TO AMEND "THE ZONING ORDINANCE OF THE CITY OF <br />SOUTH BEND, INDIANA ', ALSO KNOWN AS ORDINANCE NO. 3702, BY <br />THE ADDITION OF EXTRA REQUIREMENTS IN REGARD TO THE USE OF <br />LAND FOR THE MAINTENANCE OF USE AND OPERATION OF STREET <br />SURFACE, OPEN LOT AUTOMOBILE WASHING OPERATIONS <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an <br />opportunity to be heard thereon. Speaking in favor of the Ordinance was Gus Prathafakis, who operates Gussies Shoe <br />Repair Shop at 736 South Michigan Street. <br />Councilman Kroll made a motion that the Ordinance be referred to the City Planning Commission for public hearing, <br />Councilman Krueper seconded the motion. Motion carried, <br />ORDINANCE ' <br />AN ORDINANCE AUTHORIZING THE DONATION OF LAND TO AID IN THE <br />ERECTING OF AN ARMORY IN THE CITY OF SOUTH BEND <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an <br />opportunity to be heard thereon. Councilman Tellson made a motion that the Ordinance go to the Council as favorable. <br />Councilman Kroll seaDnded the motion. Motion carried. <br />ORDINANCE <br />AN ORDINANCE PROHIBITING THE THROWING OR DEPOSITING OF LITTER <br />IN PUBLIC PLACES IN THE CITY OF SOUTH BEND, INDIANA; REGULATING <br />THE DISTRIBUTION OF COMMERCIAL AND NON - COMMERCIAL HANDBILLS; <br />CONTROLLING THE DEPOSITING OF LITTER ON PRIVATE PREMISES; PRO- <br />VIDING A LIEN FOR CITY CLEARANCE; AND PRESCRIBING PENALTIES FOR <br />THE VIOLATION OF ITS PROVISIONS <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an <br />opportunity to be heard thereon. After discussion among the Councilmen, Councilman Muszynski made a motion that the <br />Ordinance be put back in the Ordinance Committee and Councilman Coleman seconded the motion. Motion carried. <br />ORDINANCE <br />AN ORDINANCE TO AMEND SECTIONS 8, 13, and 25 OF CHAPTER 30 OF <br />THE GENERAL ORDINANCE NO. 3709, SAID CHAPTER 30 REFERRING TO <br />TREES AND SHRUBS <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an <br />opportunity to be heard thereon. Councilman Kroll presented a letter from the Superintendent of the Park Department <br />requesting early passage of the Ordinance in order to proceed with elm tree removal. <br />Councilman Allen made a motion that the Ordinance go to the Council as favorable. Councilman Ladewski seconded the <br />motion. Motion carried. <br />ORDINANCE <br />AN ORDINANCE PROVIDING FOR THE CONTROL OF LAND SUBDIVISION AND THE <br />APPROVAL OF PLAT AND REPLAT OF LAND WITHIN THE TERRITORIAL JURIS <br />DICTION OF THE SOUTH BEND CITY PLANNING COMMISSION; PROVIDING PENALTIES <br />FOR VIOLATION AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT <br />HEREWITH <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an <br />opportunity to be heard thereon. Councilman Kroll made a motion that the Ordinance go to the Council as favorable. <br />Councilman Krueper seconded the motion. Motion carried. <br />There being no further business to come before the Committee of the Whole, Councilman Muszynski made a motion to <br />adjourn. Councilman Kroll seconded the motion.
