r` <br />REGULAR MEETING MAY 281 1962 <br />ORDINANCE NO. 4467 - - -62 <br />AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE <br />NO. 3702, AS HERETOFORE AMENDED AND SUPPLEMENTED <br />(5 acres of land along Maple Road) <br />The Ordinance was given third reading and passed by a roll call vote of 8 ayes, 0 nays, 1 absent (Councilman Muszynsl <br />ORDINANCE NO. 4468 - - -62 <br />AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE <br />NO. 3702, AS HERETOFORE AMENDED AND SUPPLEMENTED <br />(109 acres at Maple and Lathrop) <br />The Ordinance was given third reading and passed by a roll call vote of 8 ayes, 0 nays, 1 absent (Councilman Muszyn- <br />ski). <br />ORDINANCE, FIRST AND SECOND READING <br />AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN THE SANITATION <br />FUND $15,767.55 <br />The Ordinance was given first reading by title and second reading in full. Councilman Coleman made a motion that <br />the Ordinance be set for public hearing on June 25, 1962. Councilman Tellson seconded the motion. Motion carried. <br />RESOLUTION NO. 9 <br />RESOLUTION TO TRANSFER $140,000.00 FROM THE GENERAL FUND OF <br />THE CIVIL CITY OF SOUTH BEND TO THE GENERAL SINKING FUND OF <br />THE CIVIL CITY OF SOUTH BEND <br />WHEREAS; by-authority of Chapter 71 of the Acts of 1961, of the General Assembly of the State of Indiana, also found <br />in Burns Indiana Statutes 61 -1207 and 61 -1208, the Common Council of the City of South Bend has the authority <br />to transfer monies from one fund having a sufficient balance to another fund which is depleted; and <br />WHEREAS, the General Fund of the Civil City of South Bend has a sufficient balance and the General Sinking Fund of <br />the Civil City of South Bend is depleted; and <br />WHEREAS, monies have not been delivered by the St. Joseph County Treasuruer and the St. Joseph County Auditor to the <br />Civil City of South Bend, from the 1961 taxes payable in 1962; and <br />WHEREAS, sufficient monies will be available from the St. Joseph County Treasurer and Auditor to pay to the City <br />monies due and owing to and by virtue of taxes to be derived from personal and real property; and <br />WHEREAS, said monies are anticipated to be received on or before the 15th day of June, 1962, <br />NOW, THEREFORE, BE IT RESOLVED, that the Controller of the City of South Bend, be authorized to temporarily trans- <br />fer the sum of $140,000.00 out of the General Fund of the Civil City of South Bend, to the General Sinking Fund of <br />the Civil City of South Bend, and that said repayment from the General Sinking Fund to the General Fund be effected <br />or before the 15th day of June, 1962, and <br />BE IT FURTHER RESOLVED, that the Controller issue a warrant and receipt for the amount of said transfer, and that <br />said warrant shall be endorsed and deposited in the depository account designated for said General Sinking Fund, and <br />BE IT FURTHER RESOLVED, that no appropriation shall be required for the said transfer, and said repayment, and that <br />no interest shall be charged on said temporary transfer. <br />lsl Joseph T. Motion <br />carried by a roll call vote of 8ayes, 0 nays, l absent (Councilman Muszynski). <br />There being no further business to come before the Regular Meeting of the Council, Councilman Coleman made a motion <br />to adjourn. Councilman Lehman seconded the motion.
