ORDINANCE, THIRD READING <br />AN ORDINANCE APPROPRIATING FROM PARKING METER FEES AND FUNDS. <br />THE SUM OF $16,000.00 FOR AN OFF- STREET PARKING SURVEY TO THE <br />L 0 S T BOARD OF PUBLIC WORKS AND SAFETY OF THE CIVIL CITY OF SOUTH <br />BEND, INDIANA <br />The Ordinance was given third reading and lost by a roll call vote of 5 nays (Councilmen - Ladewski, Tellson, Glass, <br />Krueper and Muszynski) and 4 ayes (Councilmen Kroll, Allen, Coleman and Lehman). <br />ORDINANCE NO. 4375 - - -61 <br />AN ORDINANCE AMENDING ORDINANCE NO. 3702, COMMONLY KNOWN AS <br />THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, <br />AS AMENDED (Self- service Laundries) <br />The Ordinance was given third reading and passed by a roll call vote of 9 ayes, 0 nays. <br />ORDINANCE, THIRD READING <br />AN ORDINANCE CONTROLLING THE OPERATION OF COIN - OPERATED DRY CLEANING <br />L 0 S T ESTABLISHMENTS <br />The Ordinance was given third reading and lost by a,roll call vote of 9 nays, 0 ayes. <br />ORDINANCE, FIRST'AND SECOND READING <br />AN ORDINANCE APPROVING A LEASE ENTERED INTO BY AND BETWEEN THE <br />MUNICIPAL CITY OF SOUTH BEND, INDIANA, HEREINAFTER REFERRED TO <br />AS THE "LESSOR" AND SOUTH BEND SCREW PRODUCTS, INC., HEREINAFTER <br />REFERRED TO AS THE "LESSEE" FOR THE PREMISES DESCRIBED AS: THAT <br />PORTION OF EAST WASHINGTON STREET IN THE CITY OF SOUTH BEND, <br />INDIANA, EXTENDING FROM THE ST. JOSEPH RIVER ON THE WEST TO THE <br />EAST RACE ON THE EAST <br />The Ordinance was given first reading by title and second reading in full. Councilman Krueper made a motion that the <br />Ordinance be amended in that the legal description of said property include: "To exclude the area that would be the <br />width of Gintz Avenue extended on the East." Councilman Lehman seconded the motion. Motion carried. <br />Councilman Lehman made a motion that the Ordinance be set for public hearing on May 22, 1961. Councilman Muszynski <br />seconded the motion. Motion carried. <br />RESOLUTION <br />RESOLUTION OF COMMON COUNCIL OF SOUTH BEND, INDIANA APPROVING <br />UNDERTAKING OF SURVEYS AND PLANS FOR URBAN RENEWAL PROJECT ON <br />THREE - FOURTHS CAPITAL GRANT BASIS AND FILING OF REQUEST FOR <br />CONCURRENCE BY ADMINISTRATOR IN COMMENCEMENT THEREOF. <br />WHEREAS, under Title I of the Housing Act of 1949, as amended, the Housing and Home Finance Administrator <br />is authorized to extend financial assistance to local public agencies in the elimination and prevention of the spread <br />of their slums and urban blight through the undertaking of urban renewal projects; and <br />WHEREAS, it is desirable and in the public interest that the City of South Bend, Department of Redevelopmeni <br />prepare surveys and .plans, in order to undertake and carry out an urban renewal project on a three- fourths capital <br />grant basis pursuant to Title I in that area proposed as an Urban Renewal Area,, situated in the City of South Bend, <br />County of St. Joseph, and State of Indiana, which is known as Chapin Street Area: <br />NOW, THEREFORE, BE IT REXOLVED BY THE COMMON COUNCIL, CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: <br />1. That the proposed Urban Renewal Area described above is a slum, blighted, deteriorated, or deteriorat <br />area appropriate for an urban renewal project and that the undertaking by the City of South Bend, Department of <br />Redevelopment of the preparation of surveys and plans for an urban renewal project of the character contemplated by <br />Section 110(c) of Title I in the proposed Urban Renewal Area is hereby approved. <br />2. That the financial assistance available under Title I to assist urban renewal projects will be needed <br />to enable the City of South Bend, Department of Redevelopment to finance;.the undertaking of the proposed Project. <br />3. That it is cognizant of the conditions.that are imposed in the undertaking and carrying out of urban <br />renewal projects with Federal financial assistance under Title I, including those relating to the relocation of site <br />occupants and the provision of local grants -in -aid and the requirement that as a condition to the execution of a <br />contract for a loan or capital grant for an urban renewal project the locality must present to the Housing and Home <br />Finance Administrator a workable program, as set forth in Section 101(c) of Title I, for utilizing appropriate public <br />and private resources to eliminate and prevent the development or spread of slums and urban blight; and that it is th( <br />sense of this body: (a) that a feasible method for the relocation of families displaced from the Urban Renewal Area, <br />in conformity with the requirements of Title I, can be prepared, (b) that local grants -in -aid can and will be provide( <br />in an amount which will be -not less than one - fourth of the net project cost of the Project and which, together with <br />the Federal capital grant, will generally be equal to the difference between gross project cost and the proceeds or <br />value of project land sold, leased, or retained for use in accordance with the urban renewal plan, and (c) that, in <br />addition to the local grants -in -aid, there will be provided funds in an amount necessary to pay such costs of the <br />Project (including but without being limited to the costs of title, appraisal, negotiating, and any other expenditure: <br />incidental to the acquisition of land, surveys -and plans, legal services, taxes, etc., and the administrative and <br />overhead expenses of the City of South Bend, Department of Redevelopment with respect to the project) which, pur- <br />suant.to the proviso in Section 110(e) of Title I with respect to projects on a three- fourths capital grant basis, <br />are excluded from gross project cost. <br />(4) That the filing by City of South Bend, Department of Redevelopment of a request for concurrence by the <br />Housing and Home Finance Administrator in the commencement of surveys and plans for an urban renewal project to be <br />undertaken on a three- fourths capital grant basis in the proposed Urban Renewal Area described above is- hereby <br />approved. <br />/s/ Joseph T.
